My husband is a sergeant in the Army National Guard and his unit was deployed for a year at the beginning of the war in Iraq (mid-March). Under the Soldiers' and Sailors' Civil Relief Act, all of our loans are capped at a 6% interest rate until his deployment ends. It's up to the soldier's to send a letter and not required, but helpful, a copy of his orders to the companies that you have loans with, alerting them of your active duty status and their obligation under the law to lower your interest rate.
The company must then immediately comply and if they feel that the deployment does not pose a hardship, then they can dispute the lowered interest rate. If it is found that it is not a hardship on the military homeowner, then they can reject the claim. That rarely happens, since our Army, God Bless them, doesn't pay it's soldiers very well.
Aurora Loan Services is only one of five companies we have loans with, all others being credit card accounts. Our account had just recently been sold to Aurora Loan Services by Fifth Third Bank. The first company to comply to the SSCRA (Soldiers' and Sailors' Civil Relief Act) was Sears. What a relief to actually be making head way on our account, instead of our payments going towards the original 23.99% interest rate (that's a whole other rip-off). After sending a certified, return-receipt letter and a fax to Mr. Robert Lee at Aurora Loan Services (in charge of the SCCRA dept.) and receiving a return receipt that they had received the letter and deployment orders on April 8th, 2003 I waited patiently for our rate to change.
Checking my account status on-line and calling the customer service department. A month later, they still had not complied with the law. All the while, I am making full payments at the higher interest rate. Each time I called customer service, I was put on hold for 15 minutes, or more. When I would get a hold of a real person, they would transfer my call to the "proper department" who would then put me on hold and then "accidentally" hang up on me. This happened three times. That's very frustrating for anyone, especially for this mom, who's only time to make business calls is while her active and sometimes loud one year old baby is sleeping.
One afternoon, I spent an hour waiting on hold and briefly speaking with a rep. before being transferred and eventually hung up on. When I finally talked to someone in a customer service department (I hadn't even gotten to the SSCRA dept. yet), I was told that Mr. Robert Lee, "the guy that handles our SSCRA accounts" wasn't available, but he would call me right back or on Monday (it was Friday). I was starting to feel like they were trying to get rid of me or discourage me from pursuing my husband's right as a self-sacrificing soldier to receive some financial relief.
One customer service rep. even went as far as to tell me that because of the SSCRA, they are keeping my loan documents in "the vault" and she couldn't tell me what my new payment would be without going into "the vault". The whole reason I called her was to find out how much money to send them at my new interest rate. She told me that "they have to accept a payment from me if I send it". I have no idea what that means. She was cryptic and rude.
The next time I called, I found a sympathetic ear with a lady who's son is a Marine in Kuwait. She said I had to give them time and not to lose hope and to call back in 2 weeks. I did, and nothing changed. So in early May I sent another certified letter, return-receipt stating that they were in non-compliance with the SSCRA and that they should call me immediately and also update my account appropriately. Also under the SSCRA, they must pro-rate your interest rate to the 6% to the day of deployment, in this case March 26th. So every day that passes by, they are owing me money or a credit to our loan, but I have a sneaky suspicion I will have to fight tooth and nail for that.
That is if I ever get to talk to Mr. Robert Lee, SSCRA department guy. I just checked my account on-line this evening, hoping that they would have changed the interest rate by now and it's still at 8.5%. On top of that frustration, they still hadn't credited our account a payment made to our loan on March 29th to Fifth Third Bank just before the account was transferred to them. I had to call Fifth Third Bank and ask them to update my account, since when I called Aurora Loan Services, they said they couldn't help me. On top of all this, I am being charged interest and late fees for that payment. Fifth Third Bank had the right to hold my payment for 23 days before transferring it to the new company. I have some complaints about them, too.
Meanwhile, to keep my account current, I'm sending payments of $1,074 every month, much higher than if my interest rate was at 6%. Also under the SSCRA, I only have to pay the interest on my loans, not the principle. So what's this poor Army wife to do? My husband can't help me from where he is (currently in the states, still), otherwise I would ask him to tell his Commander and get some help from the Army lawyers.
I'm wondering if they think that if they stall long enough, now that the war if over, that the Army will send some of their soldiers home and then they won't have to comply. My husband is deployed for a year, his new mission is Homeland Security, and he's not coming home until next June. Or maybe the SSCRA dept. guy is so busy that he really is just that far behind - but couldn't they just call me and tell me that? Or tell me that when I call them? If someone reads this and has an idea or knows more about the SSCRA and my rights, please pass it my way.

How can a company get away with that kind of behavior. Have they been reported to the state or feds? How about sending all the negative information to the affected's senator or a local television/newspaper. What about consumers rights advocates?
Thank god I have not had this happen,I know this kind of thing happens,not just with ALS, but with any kind of loan company, even with credit card companies. I look at credit reports all day long.
Why do you think they target specific individuals?
I think companies get away with this because consumers feel very small in comparison with the big goliath companies. Consumers must stand together and complain long and hard to get changes made.
Also,some advice to other's. Make sure you review your credit report at least once a year. If you are ever turned down for credit you are entiled to a free copy. Credit Bureaus make all kinds of mistakes, but generally the information they report is taken from the creditors. More often than not, I see people who don't even know what is on their credit report until they are declined.

Military issues and rebuttles aside, you have a valid point. I worked for a company who sold loans to ALS and I have seen them hurt many people. I watched them send two borrowers to foreclosure, even though each borrower made all their payments on time and had cleared checks to prove it. I have seen them tell borrowers they have missed payments or made late payments, then report it on their credit, refuse to remove it, and again the borrowers had proof that the check was cleared before the due date of the loan. I have also seen them take months to post a check that had arrived on time. Some of the borrowers I delt with went as far as to refinance their million dollar loans after just a few short months, at the cost of $10,000 plus in closing costs. Anyone who gets transferred to this company, keep good records and watch your credit report. Better yet, RUN!

It's my understanding that when the Reserve or Guard is put on Active Duty status, they receive the same pay as active duty personnel. If this is not correct, then I apologize. Therefore, I don't think I'm comparing apples to oranges, as you state.
Why you think I sound bitter, I don't know. Also, I'm not talking about 20 years ago. I stated I was in for over 20 years. As a matter of fact, I am living off my army retainer pay.
It is not actually a pension or a retirement. Just for the record, I was enlisted, so it's not that big of check, but it allows me and my wife to live comfortably.
The BX/PX and commissary are fine for shopping, but if you watch the papers, you can easily find many items cheaper outside, even with the sales tax added on. Just a quick example, a carton of cigarettes is cheaper at a quickie mart that on base, at WRAFB.

I guess I can see this from both sides. I work for a major credit card company. I have worked in customer service and collections. People should try to see both sides of the coin. SSRA is a federal law and companies must comply. Fortunately, most do without problems. My company does and I can see how it helps. From a collectors view, you have to understand that the vast majority of people who are delinquent are not honest and wont pay unless they are called etc. Collectors are a necessary evil. They do help consumers by getting payments to keep interest rates low for other people. My advice is to keep trying. Eventually it will get taken care of. If you are ever in dire straits, the best thing is to call the creditor BEFORE you become delinquent,and make a token payment of something to show good faith. If you get bad or unfair treatment, ask for a supervisor. I am also a customer of ALS. They hold my mortgage. I have also had customer service issues. I did have to keep calling back, but it finally was taken care of. Also, God bless and thank you for the sacrifice that soldiers and their families have made for our country. I am most definitely against this military action, but I do respect the sacrifices made.

Jasper, If I understand your postings you were active duty for 20 years-not in the national guard. I was active for 81/2 years. I was able to "make due" on my pay because I was either living in the dorms on base or was given a housing allowance. I also received food rations or ate in the chow hall. The bx and commisary had lower prices than off base, etc. etc. You are trying to compare apples to oranges when you compare active to guard. I am a disabled vet. You sound like a bitter person and you are talking about 20 years ago. What are you doing now,living off your military retirement or do you have other sources of income?

HELLO EVERYONE, I AM AN E-6 (RESERVIST FOR 8 YEARS) WHO IS GETTING ACTIVATED TO BE A MILITARY INSTRUCTOR WITHIN THE STATES.
I HAVE A TWO YEAR OLD SON, MY HUSBAND AND I HAD BEEN TRYING TO HAVE ANOTHER CHILD SO WE CAN HAVE THEM CLOSE IN AGE. WE JUST BOUGHT A BIGGER HOUSE AND GUESS WHO MY LOAN IS WITH...
I PUT AURORA LOAN INTO THE SEARCH ENGINE TO FIND THE SITE TO SEE ABOUT GETTING MY RATE REDUCED. I DID NOT EXPECT TO HAVE THIS WEBSITE POP UP. BUT, I AM GLAD IT DID.
THE THING WITH ME IS THAT I COULD NOT LIVE WITHOUT MY HUSBAND AND CHILD. MY HUSBAND HAS AGREED TO COME LIVE IN AN APARTMENT NEAR THE BASE I WILL BE AT. I WILL BE TAKING A SMALL PAYCUT FROM MY POLICE DEPARTMENT AND MY JOB WILL BE THERE WHEN I GET BACK.
HERE'S THE GLICH. MY HUSBAND IS A CONTRACTOR AND WILL BE TAKING AT THE LEAST A 60K PAY CUT OUT THERE.
OUR HOUSE NOW IS OUR DREAM HOUSE AND I DON'T INTEND ON LOSING IT. SO WE WILL BE PAYING OUR 2,400 A MONTH MORGAGE AND 800 A MONTH FOR RENT. I KNOW THE ARMY WILL HELP ME WITH THAT SOMEWHERE.

There is no great effort involved in finding out what military pay and allowances are. All I was trying to get across is the fact that thousands of military families are able to get by on the pay they receive.
Marci,
Have you contacted your husbands NG unit? Someone there should be able to put you in touch with a JAG office in your area and perhaps they can assist you. No, I don't think what Aurora is doing to you is right, but as I stated earlier, the "POOR ARMY WIFE" hit me.
You are right, I don't know your household circumstances, but if you feel the military pay is so low, now that it has affected you, maybe you should start a campaign to have your congressman/woman see about getting larger raises.

I find Jana's comment very cold and heartless. Just because a person when they first sign that dotted line with FULL intent of paying there house payment every month has NO IDEA that he or she might get layed off or be in an accident that would cause them to fall behind. Aurora loan services has been very kind to my husband and I.
When I lost my job back in ocotober and payments became a week late and then when winter hit in and it was a choice, Pay the house payment or buy heating oil to keep the kids warm. All the people that I have talked to from Aurora have been very understading and helpfull.
I know they have their limits and now my husband and I are trying to catch up all the back payments which we could do in 1 payment if the IRS would send us our tax refund. (hung up somewhere in the blackhole called the review board.) The piont is Jana if you are a collector I feel sorry for anyone you contact if that is the attatued you have. There are some people out there that actuly do have a REAL reasion for falling behind on payments and still do want to pay them if givin half a chance and a little understanding. Heaven forbid you ever lose your job and have some hard cold decisions to make about how to pay your bills!

I am sorry to hear about both of your stories, but as a collector, you need to stop and think of the business side. If any company gave "free-bies" to everyone who called in, they would soon be out of business. I do think the Military spouse was treated incorrectly. But as for the woman who was laid off, it is a sad situation to find yourself in, but you did sign on the dotted line to make a payment every month. There was no clause that said only make a payment when you are employed.

I am mortified that Jasper would be attacking Marci and tracking down her husband's pay in an effort to rebut her issue. You have no visibility over their household expenses or their situation. Additionally, most people make more in their civilian jobs than in their reserve position, so taking a pay cut for months on end to serve your country can be financially devastating in some situations.
I have a mortgage with Aurora Loan Services and went thru a very difficult period with them after being laid off. They were rude and unconcerned and I almost lost my house as a result of it. What's worse I found a website where Auroro Loan Services sells foreclosures, which seems like a huge conflict of interest to me. You would think in the current economy that they would be a little more sensitive, but they are busy trying to foreclose and hock your home on the black market.
I am so sorry to hear that you are without your husband and having to raise your son alone. My best friend's husband is deployed and her daughter just turned one and he has only seen her once - on the day she was born premature and weighing only 3.6lbs after which he had to leave immedately. So I understand and feel your plight.
Keep fighting Aurora needs to be held to the law.
As for Jasper, I am very disappointed that you would be so harsh and perpetuation the victimization that Aurora has started.

I guess I'm still confused. The only thing I can figure is that you disagree that my complaint with Aurora Loan Services is valid because you think we make enough money and shouldn't be entitled to the benefits of the SSCRA?
The SSCRA is in place to soften the financial impact for soldiers' families. One particular section of the SSCRA specifically cites reservists/national guardsmen. The President has exercised his authority under 10 U.S.C. 673(b) to order certain Reserve Component personnel to active duty. Our soldier is entitled to certain protections under the Soldiers' and Sailors' Civil Relief Act of 1940 (SSCRA), as amended, (50 U.S.C. Appendix 501 et seq), as a result of his call to active military service and the material impact it will have on our financial income.
Otherwise, in response to my request for ideas on how to resolve the issue, I thank you for the link to the military website (I already have a copy of pertinent chapters of the SSCRA).

I'm not judging you, but your comment about "poor Army wife", just hit me. Maybe I'm taking it out of context, and if so, I apologize. I guess my point is, many military families make do on their pay. My wife and I did it for over 20 years, and my brother is currently doing it. Your husband's willingness to serve this country is no greater than PVT. Snuffy, who does it full time. I'm sorry if I sound unsympathetic, but about the only time people complain about low military pay, is when it hits them, as in your case. You stated that your husbands pay is now lower than his civilian job. Did he consider this BEFORE joining the National Guard.
Let's add up everything before we cry poor. Your husband is a Sergeant, but you don't say what his pay grade is, or how long he's been in, which affects his pay and allowances. So, for your area, if he is a Buck Sergeant, E-5, the housing allowance for Corvallis, which is the closest town I could find to Albany, is $696., which is NOT taxed. If he's been in service less than 2 years, which is unlikely, but can happen, his base pay is 1625.40, taxed. This amount goes up every 2 years. If he's been in 6 years, his base is 2204.10

Today I called Aurora Loan Services, telling myself I would try one more time, before getting legal counsel. After being transferred to 4 different people and being put on hold for a total of 35 minutes, I finally found someone to help me in the customer service dept. She told me she would take care of it and it appears she did! I will know for sure on Monday when my account has been updated, but she called me back this evening with a new payment amount and also reassured me that I would be credited back the extra interest I have been paying the past 2 1/2 months. I'm afraid to get excited, but it's further than I've gotten in the past. I guess you just got to talk to Tami!

I'm not sure what you are disagreeing with.
I certainly was not implying that we are ungrateful for the military pay my husband receives. My husband willingly and eagerly serves his country regardless of his pay. We are making considerably less money now that my husband is on active duty than he was making at his civilian, full-time job. My husband's deployment has had a negative impact on our family that can't be measured in dollars. Our son will be 2 years old when his daddy comes home. I can take pretty good care of myself, but my heart is breaking everyday that my husband's life is on the line. He was about to graduate with a degree in biochemistry, upon the completion of one very difficult class. Upon completion of his degree, he would have received a significant pay increase as well. He will also most likely miss out on a job promotion due to his absence. You see, you don't know our circumstances, so I feel it's not appropriate for you to judge us. Consider this: your pay is based on your rank and separation, and that each person's financial responsibilities vary depending on their private sector job and life, the impact is relative to each individual. How can you judge how each soldier and their families will fare in times of mobilization? Isn't it fair to say that our soldiers deserve peace of mind that their families will survive wartime as well? I hope anyone can see that the SSCRA is helping many families stay self-reliant and off assistance programs that otherwise cost the average taxpayer, not the wealthy banks.

Please read it carefully. I can understand your frustration, but I don't fully agree with you either. I served 22 years in the military and I know what the pay is like. I still keep tabs on the pay today as well, and I feel that I was always compensated well. Good Luck.
