I used to work for Ken Wincorn. He is a liar. He lies about anything and everything. Don't listen to him. Anything he says is a lie. Big shocker he is a lawyer.

Public records and statements from the Chief Misdemeanor Prosecutor show that I was retained in August 2000 by Kiana Tran Summers (aka Kiana Tran Hollenbeck) to defend her in two prostitution charges against her pending in Dallas County, Texas. As a criminal defense and immigration lawyer for over thirty years, I advised her that if she was convicted, or even given Deferred Adjudication Probation on both cases, the United States Immigration Authorities would classify those offenses as "Crimes Involving Moral Turpitude" (CIMT), and that the United States Immigration Laws are very clear on this: two CMIT's will be treated as an "aggravated felony" for statutory deportation purposes.

Accordingly, I attempted to have at least one of the charges reduced or dismissed. The facts around these offenses made it impossible for Ms. Summers to be found not guilty. However, Kimberly G. Judin, the Chief Misdemeanor Prosecutor at the Dallas District Attorney's Office, after reviewing all the facts and listening to all of our arguments, including the immigration consequences, would not approve the reduction or dismissal on either case. Later, another attorney approached a different prosecutor and this prosecutor, for reasons beyond our knowledge, made a deal to amend one prostitution charge to disorderly conduct. As Ms. Judin swore on October 11, 2003, "This disposition was completely unauthorized and was in direct contravention of my earlier decision in this case.... I shall deal with (the prosecutor who made the amendment) appropriately."

Nevertheless, Mr. and Mrs. Hollenbeck filed a grievance against me with the State Bar of Texas. Upon investigation, the State Bar of Texas Grievance Committee dismissed the grievance concluding there was no malpractice or improper actions on my part. Then the Hollenbeck's started to dispute the legal fees paid to my firm. To buy peace and to permit me to spend my time productively, I agreed to refund part of the legal fee paid. Ms. Summers and her husband signed the Settlement Agreement, accepted the refund, and THEN made these totally unfounded, false allegations. They are now forcing me to defend my reputation and ethics, as well as my expertise in both criminal and immigration law.

I hope this will give you a better understanding of the situation and my position in this matter. I am a reputable and ethical lawyer who works hard to get the best possible disposition for my clients despite the difficulties posed by the Immigration Laws when the non-citizens are charged with criminal offenses.
