What would you say if you came across a company that publishes on their website that if you sell their truck nuts for less that the prices they sell for they will not ship any future orders? That was posted on their site for almost two years until they were called on it. Then they changed it to you can set your price as in the past? But in the past, they fixed the price. Then they deny that dealers of theirs conspire with them to fix prices? I have a copy of a letter sent to TRAILERTOYS, one of their dealers, that states they can NOT discount the price because of the agreement with the manufacturer. That was Jan 09.

Then the owner of the company, John D Saller, created several identities (donwilsonflorida, bigrigtex, harry333, and posted lies regarding one of his compettitors. He accused them of identity theft and bait and switch. We have documented IP adresses proving that it came from the owner of Bulls balls. Received: from BBBHCOFFICE (unknown [71.36.165.21])

The above IP address has been used to post under the created names by John D Saller of BullsBalls and Jaydee sales llc in
AZ. Additionally, by masquerading as anonymous third party
consumers on various third party boards, John D Saller is violating the terms of use under which he is permitted to post to those third party boards. John D Saller at bullsballs.com and Jaydee sales llc.s
behavior may subject them to liability to these third parties, and may
constitute a civil and criminal violation of the federal Computer Fraud and Abuse Act 18 U.S.C. 1030 et seq.

What would you do? Well for one I would stay away from that site. The owner has breached his contract of privacy, and the web master John R Beaman of the wwwebfactory stated he had no privacy on his site that runs the checkout for sales. HMMM, Beaman gets all the personal and credit info and provides ZERO privacy.

Well, since Saller has committed felonies in my opinion, so a criminal complaint has been filed. States attorney generals have been notified and the investigation is underway.

As you can see and intuitively feel, impersonating someone to post lies about a business is criminal, in AZ it is a felony.

As you are no doubt aware, Yournuts.com is a leading supplier of novelty truck accessories sold under the federally registered trademark Your nutz.

It has come to our attention that you are engaged in a variety of tortious activities directed at Yournutz, apparently in connection with your sale of novelty truck accessories. We have two primary areas of concern.

First, it appears that you are using Yournutz registered trademark which has been assigned serial number by the United States Patent and Trademark Office

, and confusingly similar marks, to advertise your competing products. Additionally, we believe that John d Saller has registered the email address bigrigtex@gmail.com and donwilsonflorida@gmail.com, in an apparent effort to direct sales inquiries intended for yournutz to him. Use of yournutz registered trademark in the metatags for your web sites has the effect of directing individuals searching the internet for yournutz to your competing sites.

All of these actions constitute federal trademark infringement under 15 U.S.C. §1114(a) and for false designations of origin under 15 U.S.C. §1125(a), which subjects you to liability for damages including recovery of your profits, yournutz damages, and attorney's fees and costs under 15 U.S.C. §1117(a). Attorney's fees are available ‘in trademark infringement cases where the acts of infringement can be characterized as malicious, fraudulent, deliberate, or willful.' Rio Props., Inc. v. Rio Intern. Interlink, 284 F.3d 1007, 1023 (9th Cir. 2002) (upholding award of attorney's fees under § 1117(a) based on allegation that defendant acted ‘knowingly, maliciously, and oppressively, and with an intent to … injure'); see also Earthquake Sound Corp. v. For example, someone representing himself only as a bigrigtex and donwilson florida has posted a screed on http://www.ripoffreport.com alleging that yournutz is engaged in ‘price fxing [sic]‘,'mail fraud' and bait and switch ‘false advertising'. In a string of posts following the original post, ‘consumer' correctly and acurately refers to Mr. Saller as ‘arrogant', ‘dishonest', a ‘co-conspirator', a ‘coward', and someone who engages in ‘fraud and deception'.(((Redacted))) (((Redacted))) and (((Redacted))). It appears that all of the offending statements are posted by either or both of you in the guise of various disinterested ‘consumers' or ‘anonymous' posters1.

The statements you have posted to various third party sites regarding yournutz allthenutz are false, and appear to be intended to both damage his reputation and his commercial relationships with consumers and/or third party resellers of his products. Accordingly, these statements are defamatory and subject you to civil liability. See State v. Stummer, No. CR-07-0429-PR at paragraph 16, (Arizona 2008) available at http://supreme.state.az.us/opin/pdf2008/CR070429PR.pdf. Additionally, the statements intended to damage yournutz business relationships are actionable under the tort theory of injurious falsehood in Arizona. See Fillmore v. Maricopa Water, 120 P.3d 697 (Ariz. App. 2005). There are other legal causes of action available to yournutz as well, such as intentional infliction of emotional distress. This letter provides you with formal written notice demanding that you immediately cease and desist making false and injurious statements regarding yournutz, allthenutz and the owners products and business on the internet or elsewhere. Moreover, you are advised to immediately cease and desist infringing use of the yournutz trademark, any other yournutz trademark, and any confusingly similar trademark, in connection with your goods and/or services, including removing yournutz from your websites and metatags thereto.

yournutz hopes that the parties can resolve their differences without resorting to litigation. Nevertheless, yournutz is fully prepared to protect its rights. Since your wrongful and libelous behavior appears to be escalating on an almost daily basis, you are advised to take the following actions no later than Monday, February 9, 2009, to avoid a lawsuit being filed against you and your company: (1) delete all references to yournutz or any similar reference from your websites; (2) cancel your registration and use of bigrigtex@gmail.com donwilsonflorida@gmail.com; and (3) cease any further posting of derogatory and defamatory statements on the internet.

Our law firm represents JayDee Sales, LLC ("JayDee"), a limited liability
company organized under the laws of the State of Arizona with a principal
place of business in Williams, Arizona. As you are no doubt aware, JayDee is
a leading supplier of novelty truck accessories sold under the federally
registered trademark Bulls Balls.

It has come to our attention that you are engaged in a variety of tortious
activities directed at JayDee, apparently in connection with your sale of
novelty truck accessories. We have two primary areas of concern.

First, it appears that you are using JayDee's registered trademark "Bulls
Balls", which has been assigned serial number 78723552 by the United States
Patent and Trademark Office, and confusingly similar marks, to advertise
your competing products. For example, the website www.allthenutz.com,
registered by Mr. David Ham, includes references to "Bull Balls", which is
confusingly similar to JayDee's federally registered trademark.
Additionally, we believe that Mr. David Ham has registered the email address
bullsballsinfo@gmail.com, in an apparent effort to direct sales inquiries
intended for JayDee to him. Finally, we note that "bull balls" appears in
the metatags of www.allthenutz.com, and in the metatags of www.yournutz.com,
registered by Mr. David Ham. Use of JayDee's registered trademark in the
metatags for your web sites has the effect of directing individuals
searching the internet for "bulls balls" to your competing sites.

All of these actions constitute federal trademark infringement under 15
U.S.C. 1114(a) and for false designations of origin under 15 U.S.C.
1125(a), which subjects you to liability for damages including recovery of
your profits, JayDee's damages, and attorney's fees and costs under 15
U.S.C. 1117(a). Attorney's fees are available "in trademark infringement
cases where the acts of infringement can be characterized as malicious,

"false advertising". In a string of posts following the original post,
"consumer" variously refers to Mr. Saller as "arrogant", "dishonest", a
"co-conspirator", a "coward", and someone who engages in "fraud and
deception". Moreover, it appears that this is a consistent and widespread
pattern, as identical rants can be found on various other third party
websites, including by way of example only, (((Redacted))). It
appears that all of the offending statements are posted by either or both of
you in the guise of various disinterested "consumers" or "anonymous"
posters1.

The statements you have posted to various third party sites regarding Mr.
Saller are false, and appear to be intended to both damage his reputation

You will notice quite specifically that saller is refusing to sell if you don't match his price. to me this is per se anti competitive price fixing. He currently now states on his site that :

He is saying that his policy is no different than in the past, I have email from his dealer that this is still the case.
Well the link to alexa wayback shows what his "policy is" now he calls people liars when confronted with the truth of his fraud here, his defamation here and on his site, and his illegal price fixing.

To me, the FACT that he is claiming that "in the past" his policy was not to fix prices is a LIE and FRAUD. If there is a different way to look at this then I sure don't see it.

13-2308. Participating in or assisting a criminal syndicate; classification

A. A person commits participating in a criminal syndicate by:

1. Intentionally organizing, managing, directing, supervising or financing a criminal syndicate with the intent to promote or further the criminal objectives of the syndicate;
B. A person shall not be convicted pursuant to subsection A of this section on the basis of accountability as an accomplice unless he participates in violating this section in one of the ways specified.

C. A person commits assisting a criminal syndicate by committing any felony offense, whether completed or preparatory, with the intent to promote or further the criminal objectives of a criminal syndicate.

D. Except as provided in subsection E or F of this section, participating in a criminal syndicate is a class 2 felony.

13-2310. Fraudulent schemes and artifices; classification; definition

A. Any person who, pursuant to a scheme or artifice to defraud, knowingly obtains any benefit by means of false or fraudulent pretenses, representations, promises or material omissions is guilty of a class 2 felony.

B. Reliance on the part of any person shall not be a necessary element of the offense described in subsection A of this section.

site was down a couple days ago for several hours, when it came back up all the old cheap prices regarding bulls balls products had been changed to the prices that most sites charge for the products. With all the Noterity regarding using Bait and Switch Tactics at allthenutz.com, I assume they decided to make some changes trying avoid further detection.

Changing prices and small amounts of text is a really simple task. Ed hartel, their webmaster for several years and part-time video actor along with Kenneth seemed to have made a coding error.

All three of these guys can be viewed at yournuts.com, David the egotistical one leads off in all the videos, Ken (tradeshow) also know as 'consumer', the one posts most of the libelous and untrue posts on this site and many other of these types of sites all over the internet viewable there also. Ed hartel goes by his own name.

I have been buying 'bulls balls' type truck balls for years, I get a new truck every year. I am a retired big rig trucker who spends most of my time online, much to my wife's dismay, trying to find interesting things.

The other day I 'googled' bulls balls and found this website, selling the same sets that I have bought in the past from the manufacturer's site. The prices were slashed in price from what I usually paid at bullsballs.com.

I then went to bullsballs.com and checked their prices, they were still the same as they have been for years. I then clicked on a link called Compare Imitators, I've been there a couple of times before, it is page the boys over there put together a few years back comparing the other companies, products, prices and services. Other information under 'updates' tells a pretty sorid story about the Ham Brothers and their lack of business ethics.

According to Information at bullsballs.com, this allthenutz, isn't even a dealer for them, they indicate that they are an Unauthorized Dealer and I knew these were the real bulls balls, so I wondered how they had these balls for sale if they aren't a dealer. So i went back to the manufacturer's site and looked around some more and discovered that these guys must be buying
their balls from some other Authorized Dealer in small quantities and placing pictures and info on their site so that they could get ill gotten
traffic, when people searched for truck balls. By doing this, they seem to be using the trademark bulls balls illegally.

Well, I decided to call allthenutz, get the lowdown and see why their prices are so cheap. After talking to them, and asking if these were the real bulls balls, they said yes. Well, I buy all my stuff online and am always trying save a few bucks, I asked if the chrome and blue bulls balls were in stock, the answer was no, I asked how come it says they were both in stock, I don't
know, I'll check. Somebody else came to the phone and said the webmaster hadn't updated the page yet and he tried to switch me to one of their
smaller nuts.

It was then I really started to get the run around, this person kept trying to get me to buy something else and started to get kind of nasty when I kept saying no, I only want the bulls balls. So I asked about other colors, they
were out stock too. I knew then, I was being had and told him so, he hung up!

Well, combined with what I just read about this company, I decided to call my old trucking buddy and asked him to call and order some, the very same same thing happened to him.

In the posts above, they made ridiculous claims and even though I asked them to post proof, they have not and cannot because they make them up as they go along.

They own many sites selling the same type of products as I do within this niche market of Truck Balls. One of them, allthenutz.com even has my products available even though he is NOT an AUTHORIZED DEALER, they have tried may times to become one and I refuse, because I do not want to be associated with these type of unethical, lying, unscrupulous people such as the HAM Brothers, who operate accordingly, out of David's garage after ten years of struggle to topple me and my company.

They obtain my products through "Back Door" methods, allowing them to post
pictures and create text on their website, thus allowing them to have their sites come up in search engines when people search for "bulls balls", which is the most often searched set of "key words" used by people looking for this unique and controversial product on Google, Yahoo and MSN and other search engines

Once a potential buyer goes to their site they see our Superior Products, slashed in price, and then , I have often thought, they probably used "bait and switch" tactics to sell their own inferior products'.

The other day, I found a posting, that seems to make my suspicions true, at least in this guys situation and his fellow trucker friend, because of what his posting indicated regarding allthenutz.com using "bait and switch" tactics.

Secondly "bulls balls" is a BullsBalls.com Registered trade mark and they do not have, and never will get my permission to use legally on their sites.

In many of Kenneth's postings, also in two of his threatening voice mails left on my business phone, and one to one of my employees at a different business phone, he verbally threatened her.

He alludes to the fact that he works within the legal community in Albuquerque, NM where he resides and carries on these unscrupulous attacks on me and my company which is nothing more then a successful competitor.

I have long suspected that he is nothing more than a "wanna be" attorney, he probably often wonders why that has not and will never happen

for sale, barter, use or consumption in this State.

do all or any or any combination of the following:
(1) Bind themselves not to sell, dispose of or transport any
article or any commodity or any article of trade, use, merchandise,
commerce or consumption below a common standard figure, or fixed

(2) Agree in any manner to keep the price of such article,
commodity or transportation at a fixed or graduated figure.
(3) Establish or settle the price of any article, commodity or
transportation between them or themselves and others, so as directly
or indirectly to preclude a free and unrestricted competition among
themselves, or any purchasers or consumers in the sale or
transportation of any such article or commodity.
(4) Agree to pool, combine or directly or indirectly unite any
interests that they may have connected with the sale or
transportation of any such article or commodity, that its price might
in any manner be affected.

The interpretation of the above is. These two,SALLER and BEAMAN are in a conspiracy to break the law as stated above.. They have been notified and put on notice. So, their denials are LIES, which is to be expected with persons of their dubious character. And YES there are criminal as well as civil penalties. Hello, My name is John D. Saller.

I created BullsBalls.com during the late nineties. Since then many people have
imitated my ideas and product line, because, with a lot of hard work it grew to
be successful and ripe for imitating.

In my opinion, this posting is not from a 'Consumer', as claimed, but is
actually Kenneth Ham, the older, more malicious brother of David Ham who has
copied many of my inventions and innovations and sells poor imitations of our
product line on many duplicated websites.

Between the two of them, they have brought the word 'malicious' to a whole new
level. Their intent regarding posting comments like these is that it will
encourage perspective customers not to buy our products and buy his imitating
products.

I am all for healthy competition in business, this constant posting of negative
comments at first upset me, but I've gotten to the point that now I just feel
sorry for them, although, I obviously have a strong dislike.

I, of course hope that people will realize he is just angry because I refuse to
allow him to become a dealer for my company and sell my product on his web site
because of his unethical ways.

Their previous malicious attack was over the holidays against my Amazon.com web
site, posting untrue information on my product pages as well as creating four
different "communities" (forums) and filling them up with libelous remarks. The
Amazon Support Team agreed and removed all their postings and are taking action
to prevent this type of irresponsible postings from ever happening again.

Also, during this same time frame, I received several harassing phone calls from
Kenneth Hamm, who I believe to be this person who posted this untrue
information, at my office. When I refused to answer the phone because my
'caller ID' indicated it was him, he then called an unrelated business of mine
and threatened one of my female employees.

At this time, I am in discussions with my attorney (finally) to take whatever
action seems pertinent to stop these two scoundrels from continuing their
unscrupulous ways in a legal fashion.

Below is a "point by point" rebuttal of their untruthful claims:

* This guy operates an internet company selling truck balls, I signed up to be a
dealer, sent in the money and now he says he didnt get my postal money order.

Rebuttal 1. - He signed up again, as a dealer, as he has many times over the
years, and I have refused every time. David bypassed our approval system and
placed an order anyway, and sent the payment via Priority Mail even after I
emailed him and told him he was not approved again as in the past, because of
his unprofessional personal and business practices.

He sent the "letterpak" anyway, and when it came into the Post Office, I asked
the Post Mistress to return it to him, which she did, the same day I received
it. We also copied the letterpak with her handwritten note and my initials,
because I fully expected some posting as this one. My best guess, he went ahead
and sent the check/MO anyway to use for present and future untruthful postings
here and elsewhere.

* He also e-mailed that he wont sell if I dont match his price.

Rebuttal 2. - This is an outright lie and I ask him to produce proof and post
that email here! Our policy is clearly stated otherwise.

* This guy has a felon conviction for assult with a deadly weapon, he doesn't
return calls.

Rebuttal 3. - This is the only true statement in all of his slanderous rantings.
I chose to plead guilty to the charge after a long time coming domestic
dispute. It is something I am truly ashamed of, but it happened. I have paid
my debt to society, it is my personal past, and is irrelevant to my business
dealings. The Hamm Clan continues to post this info in all their vicious
attacks wherever they can for obvious reasons. BTW : It is the only statement

You will also find on our site, our Third Party - Business Verified, Certified
Privacy, and Security Links where an independent company did an lengthy and
comprehensive study on us and certified us a "reputable business" for the last
ten years. It should also be noted here that their sites/companies that they
own and operate (out of their garage) are hiding behind P.O. Boxes and often
"free" email addresses such as bullsballsinfo@gmail.com, KEN4HM@aol.com and
dh4dham@gmail.com amongst many others also.

* On his website he specifically requires that you match his prices.

Rebuttal 4. - This an absolute lie. What is indicated on our "Dealer Info Page"
is :

"If you are planning to sell any of our products on-line, via your own website
or any of the many auction websites, we highly recommend that you match retail
prices on our website(s)."

This is to make it fair for ALL of our dealers that sell on the Internet.

* I contacted some of his curent dealers and they say the same thing that they
have an agreement not to sell for less than his posted price or he wont sell to
them.

emails here or write a paragraph attesting to those claims and 'digitally' swear

I looked up this John Saller guy and he has a felony arrest for assault w/ deadly weapon, I think somewhere in Williams AZ. Its time to stop this arrogant, dishonest person. I think he belongs in jail.

This rip off is continuing his devious deceptive practices, I need some help on who to file the complaint with, also need more victims to respond. If you bought one of his products you overpaid due to his continuous price fixing scheme. I got one of his dealers to admit in an e-mail that he has an agreement to fix prices.
