You cannot TRUST Thrive Learning Institute

My name is Martha. I am 83 years old and I have been scammed by Thrive Learning Institute and their affiliates. My first contact was with Brandon Yeaton, who said he represented Business Development Enterprises in Scottsdale Arizona. This was a telemarketing call. He said his company had been subcontracted by My Choice Business Services. He said he was the Marketing Director for 6 yrs with Fidelity Merchant Solutions / My Choice Business Services. He offered me an opportunity for supplemental income. I am 83 yrs old and lived on a fixed income. I really needed supplemental income.

The company told me that they offered merchant loans to companies that have been turned down by the banks. He said their company gets the names of the companies that have been turned down by the banks for Merchant Loans. They charged me $10,000 for a business opportunity to make commissions off of the Business Loans. I had to buy the leads. He told me that I was guaranteed to generate $10,000 in the first 4 months for buying these leads because they had a great success rate. I was told that I would be paid by Fidelity Merchant Solutions and that their lawyers verified Fidelity Merchant Solutions is a legitimate business. I was told that they would do all of the work for me, all I had to do was make the investment and the commissions would start rolling in. When I got the invoice with the credit card transactions, the merchant accounts that took the money from me were Thrive Learning and Focus Learning (FCS The same company).

I disputed these charges with my credit card companies and Thrive Learning Institute responded to my credit union and Chase with lies. Zachary Bradshaw, Director of Customer Relations, from Thrive Learning Institute, responded to the bank that I had taken coaching lessons and the name of the company on the notes was Independent Financial Corp. I had no idea what these people were talking about. I did not pay to take any kind of coaching lessons. I was told that I did not have to do anything but invest and they would do the work for me, for Merchant Business Loans and my transaction WAS NOT WITH THRIVE LEARNING INSTITUTE. Zachary Bradshaw from Thrive Institute signed both of the rebuttals with the banks and also sent notes stating that I had purchased a $10,000 package from them and the problems because of my age and not understanding the program.  So now Thrive Learning Institute is using several names. Focus Learning, Independent Financial Corp and many more. The part on the notes where the employee
from Thrive Learning Institute states that I was having problems because of my age is a violation of the Utah Consumer Protection Act:
CSPA, U.C.A. 13-11-4 (s) states that it is a violation to solicit or enter into a consumer transaction with a person who lacks the mental ability to comprehend the nature and consequences of the consumer transaction or the persons ability to benefit from the consumer transaction. This may apply to individuals with disabilities or a mental impairment, but also may apply to senior citizens who are not able to understand the full nature of such a commitment to a coaching or mentoring program that requires technical knowledge and a long-term commitment. Companies should be cognizant of the Divisions commitment to protect senior citizens who are often vulnerable to a sales pitch that might not be in their best interest. Be diligent in screening all prospective customers to ascertain their mental abilities, understanding of the
program, and whether it will be beneficial to them.

Every Senior Citizen who has been scammed by these Utah Coaching Companies, and there are several, please get in touch with me because I am now on a crusade after being ignored after sending Thrive Learning Institute (4) letters asking for my money and stating all of the violations that they have committed. They do not care that they have hurt me financially as an elderly woman who cannot pay those credit card debts. They do not care that they have violated several laws. They only care about scamming more people and their millions of dollars to be made at the innocent consumers expense.

 I had never authorized Thrive Learning Institute to receive that money but after sending Thrive Learning Institute, letters asking for my money back, Zachary Bradshaw called me and told me that they do work with Business  Development Enterprises, who stated that they worked with My Choice Business Services.  It seems that all of these scammers work together. Theyre just a big crime syndicate. Zachary Bradshaw told me that they would refund me $2000 out of the $10,000 they took from me, not to mention all of the fees and interest that I am paying on that money to the credit card companies.  I refused. I never made a dime from my investment. I was clearly scammed out of my money. I was misled and lied to.  The Arizona Attorney General Office has filed a lawsuit against their affiliate My Choice Business Services for allegedly violating the Consumer Fraud Act, the Telephone Solicitations Statute and Civil Racketeering statute related to telemarketing/work from home scams.   In addition to civil penalties and restitution
for victims, the lawsuit seeks permanent injunctions preventing defendants from:
 Violating the Consumer Fraud Act, the Telephone Solicitation Statute and the Arizona Organized Crime, Fraud and Terrorism Act in the future; Having any involvement in a business entity that is engaged in the advertisement and/or sale of any business opportunity in the state of Arizona; Making any and all outbound telemarketing calls to any consumer residing in the state of Arizona; and Providing their customers names, addresses, telephone numbers, and e-mail
addresses, fax numbers and/or credit card or bank account numbers to any other business.

I have been  ignored so many times by Thrive Learning Institute after sending them (4) letters asking for a refund, stating all of the violations that they have committed. They do not care that they have hurt me financially as an elderly woman who cannot pay those credit card debts. They only care about scamming more people and their millions of dollars to be made at the innocent consumers expense. Im sure there are thousands of people In the same boat as I am.

I have now read all about these different companies online and have seen that they have scammed several elderly and disabled people out of millions of dollars.

On September 18, 2009 the Utah Division of Consumer Protection entered into a Consent Agreement with Thrive Learning LLC. The Utah Division of Consumer Protection and Thrive agreed to the following: That Thrive will enter into an Exclusive Marketing Agreement with any and all telemarketing companies it does business with and that this agreement will stipulate required selling practices for all telemarketing companies selling Thrive's product; that Thrive will disclose to each consumer specific items including the purchase price, description of products purchased, management or hosting fees, suggested prerequisites to operating an e-commerce website, that there are no guarantees or promises of success or money back, that hard work is required to be successful and that the consumer has a three day right to rescission; and other items contained in the agreement as written.
