This company lies to you and takes your money. here is my story.

Ive been trying to purchase a tow truck for a while now, but my credit is not good, so finally early this year (2006) Juan (sales manager)from Tow Industries said he could help me if I would give him some money for a deposit to show the bank that how serious I was about getting a truck, I said ok give me some time and then my dad called to talk to him and per Juan he told my dad that if this loan did not go through then he would reverse his credit card of $500.

Supposebly I was approved but I never saw a contract or anything, then I asked Juan what is going on and he kept giving me the run around, so I then asked him to reverse my dads' credit card, he said he could not do that, I then asked him to try to finance a less expensive truck and he said once again ok, I'll let you what I can do, again he failed to contact me.

I kept getting the run around still no answer. Remember this has been going on least 3 months if not longer. I finally called to speak to Juans' supervisor ( I forgot his name)and he said he would call me, I still have not received that call its been about 21/2 weeks. I then called Juan asked him to reverse the credit card and he said he would do it when he had a chance, not reversal yet.

So I decided to call and speak to Mark (he is the main owners son) and he gave me such a bad attitude and such unprofessional attitude that he was no help at all. He said he would call me back but he did not call me personally he had some other person call me to tell me that they where not going to reverse the credit card and that they contacted the c.c. company to not reverse the charges and he gave me there attorneys phone #. So all in all my father and I are going to fight them for what they have to us.

DON'T DEAL WITH THEM AT ALL!!!!!

yes finally i spick out i am the dad i put  the $500.00 dollars depocit but any way he say  that was not going to refund my money well, only tuck one phone call from me to the credit card company and i got my money back he try to fight he loss he did not want to  return my money but you know what  i am a business man i am a mechanical engineer and lic  hvac contractor in las Vegas Nevada any way what you do in Vegas stay in las Vegas my company is WWW.AMRCOHVAC.COM

NOT THAT I BELIVE THAT HE IS ENTITLED TO THE MONEY OR TO ANYTHING ELSE IN LIFE...THIS IS WHAT I CALL JUST THROWING IN THE FLAG...JUST LIKE THE WAR ON TERORISM THIS WAS A USELESS BATTLE...BUT MARK MY WORDS...MY COMPETITORS HAVE WARNED ME ABOUT HIM BUT I WAS ONE STEP AHEAD OF THEM..BEING THAT I WAS ALREADY A VICTIM OF HIS B/S ACTIVITY..

I BELIVE THAT MR. GARCIA WITH HIS ATITUDE WILL FAIL IN ALL THAT HE ATTEMPTS.. HEARING ALL SORTS OF NEGATIVITY FROM EVEN THE PEOPLE THAT DOES BUSINESS WITH SUCH AS ASSURION ROAD SERVICE, COACH NET. While I TOTALLY sympathize with you because Julio TOTALLY wasted your time and energy, you technically have no right to the $500. That was for a deposit for a truck...not for test drive gas, time & effort, etc. We in the accounting business call that "COG" or Cost of Goods Sold (in your case, cost of doing business). It's another expense against your bottom line, which at the end of the year goes against your income and at least makes your company income tax lower. A deposit is listed as an Asset until the deal goes through, then it's converted to Income.

While Julio sounds like he's all talk and no action, and I DO sympathize, you really must credit his dad the $500 back to his card. The dad actually should have had the card co. do a chargeback a long time ago; apparently they're not sophisticated enough to know this but by now they should've gotten a clue.

And calm down and just don't make the same mistake again with an obvious credit risk!

Any one can jump on the bandwagon and try to help this poor individual Julio and try to make it seem like he's the victim. The only victim here is me. Any one that knows the name TOW INDUSTRIES knows what they are in for when they come here. My prices a higher than any of my competitors and our service is beyond poor. I hear negative things about my company day in & out. So Mike....if you have something to say to me call me at (323)660-4866 ext 1 your bitching and crying does not scare me...if you really want to help Julio why don't you represent him in court....

He never signed a contract for a specific truck at specific terms. He has the right to reject any deal you may propose because the payments are too high, or whatever other reason, because he didn't sign anything agreeing to that specific deal. There is no deal.

If the money is on Julio's dad's credit card, his dad should call the bank and charge it back. The bank will take the money back because it was a deposit for a truck that was NEVER DELIVERED.

Like I have said it before, considering that I will return Julio's money. Remember that I pulled strings to get him financed. Woking on his deal for more than 2 months, working with many, many banks I was able to get him financed, putting my own name on the line for this ungratefull person.

My competitor whose names I will no metion called me and warned me about this individual. But me trying to be the nice guy with this person gets the royal kick in the back. He did the exact same thing to my competitor, that's why I asked him for a deposit to see how serious he was, And with him constantly calling every day to see if he was financed..It felt like I was on a Mervins commercials where the ladies are at the doors waiting for them to OPEN...OPEN...OPEN...

Like I said before.. He was aproved for finance.. and was well aware that his payment would be high due to his excellent bad credit and no down payment..it is obious that his payment would be high....ask anyone who owns a tow truck if their payments are $299.00 a month no one does.. you can'e even buy a freekin KIA for that price...so help me GOD. IF JULIO HAS ANYTHING TO SAY...HE SHOULD SPEAK NOW...OR FOR EVER HOLD HIS PEACE...EVEN IF JULIO TOOK THE COMPANY TO COURT AND SUED AND WON...I WOULD NOT PAY HIM JACK...I WOULD PERSONALLY RUN HIM OUT OF THE TOWING BUSSINESS SO KICK ROCKS MR DEADBEET......

Unless the paperwork for the deposit states it is NONREFUNDABLE, the company owes a refund to Julio. He may have wasted the time and fuel of the dealership, but that IS the cost of doing business.

If you know the customer is a waste of effort, cut your losses quick and kick him/her to the curb. We all know who's who in the first 5 minutes of dealing with someone.

Pony up the $500, and call it a day.

Stephen said it perfectly. You looked at his credit report, you should have just told him (politely, I'm sure) there's no way we can do anything for you. It's your problem letting someone take so many test drives when it's obvious that he's not qualified to buy. Then you eagerly take his cash with NO INTENTION of ever possibly giving it back if, as will likely be the case, the sale doesn't close.

To anyone in Julio's situation, best not to give a dealer any money down until you have a contract signed and approved.

In the many years that TOW INDUSTRIES has been in bussiness we have dealt with many sorts of people. But meeting with someone like Mr. Julio G. is something else. While considering for us to return his money, Considering that the company wasted more than two months trying to finance his tow truck, he has the huevos to bad mouth TOW INDUSTRIES. Mr. Garcia has always in so many words always wasted our time in the way that he is always all talk but no action. We are here to service our customers... but Mr. Garcia has gone well above & beyond the service expectations..when he was finally aproved for a loan...Mr. Garcia flakes out, No matter what or how you look at it I may seem like a jerk but MR. Garcia Has jerked me off long enough

While you personally take exception to this customers credit history...why no mention of the 500 you are holding illegally. What service or product did you provide that would give you legal attachment to money he gave over in good faith? Surely you do not think you will prevail in court setting with an argument that you are billing him 500 bucks for tests drives? Cmon Mark, give the man his money, because if he takes you to court, or worse, arbitration, your going to lose and suffer additional penalties.

There are two sides to every story.

Over the past two years, Mr.Julio I DON'T LIKE TO PAY MY BILLS GARCIA, has been coming to our shop saying he is going to buy a towtruck. First he comes in saying he is going to buy a tow truck. He test drives about a dozen towtrucks, but never has the required $1000 for a down payment. Since he has been comming to our shop for the last two years, the owner lowered the deposit to $500.

Despite all of the bad credit on his credit report, and the fact the he has already spent the $500 in gas in all of the test drives, I was still willing to work with him. I finally got him approved after two months on a certain ford truck, but he said that the payment was too high for him. He then wanted us to finace him on an older truck, for less money. Because of his bad credit history the bank would not take the risk. Furthermore he was expecting to have payments equivalent to a Hyundai and could not even furnish the proper insurance to cover the towtruck.

So Mr. Garcia start paying your bills and stop HARRASSING THIS COMPANY. You already have a bad name in the tow business. NOBODY LEND MR.GARCIA ANY MONEY AND DON'T DO BUSINESS WITH HIM. DEADBEAT!
