Beware of West Asset Management a scam collections company
This company makes over five million calls per month to harassment people about credit debts. They called me daily and on & on without stopping. They're staff are extremely rude as all they want is your money. I tried to call them and they hung up the phone on me, they didn't give a dam and with your credit report, they will mark allover it without your authorization.
When I tried to settle with West Asset Management, they debited funds out of my bank and refused to give me a receipt. They refused to send any form of receipt and they asked I signed a form so I would approve the funds without anything saying settlement paid in full, they refused. I paid this company and now I am going have to file this as fraud with my bank because they refuse to send me any receipt. Meaning if I sign anything, they can collect even more as I would allow them to continue to collect without a settlement on any letter head. With no receipt of payment nor a letter head with settlement, why should I sign a form? It is scam, a complete scam.
Beware of this method; also beware of using Western Union as Western Union does not insure any transfer. Western Union does not insure your money when you send it, E-Bay has tons of West Union fraud as sellers can use fake names with fake identifications at any Western Union location where to pick up the funds. West Asset Management uses Western Union (and Western Union fees are a rip-off), please do not accept this form of payment. You could lose all of your money and they will not give you a receipt either.
Don't get rip-off from West Asset Management, this is a bad collection company as they have been harassing me for 2 years on a disputed hospital where the hospital denied me the right to dispute the bill in the first. West Asset Management bought the account from Sun Rise Medical Hospital in Las Vegas (with is owned by Blue Cross) where I do not authorized them to put the account to collections but they do so anyway.
Please beware people; please do not fall for this West Asset Management trap.

To West Asset Management
I am making a change in my decision about West Asset Management on my ripoff report I left about them and I want to say I apologize for making this report. While they are not perfect as businesses have problems as West Asset Management did but nobody is perfect. I am not a fan of RR and wished I never used this site for making complaints on businesses. Since they do not allow authors to remove reports I am left leaving a sorry note to West Asset Management. I knew collection agencies are not well liked and how they deal with collecting debt but I am also understand people don’t want to pay their bills. I paid my bills and settled with West Asset Management years ago. Everybody should pay their bills and if not at least work out something with any collection agency even if they are hard to deal with.
I am sorry I made this report, please accept my apologies as I had a change of heart and want to say I am sorry as much as I think they may feel the same way.

""Problems
I wish people were more informed before they posted on this site.""
Indeed, especially folks as you.
""1. They can call you as many times as they want in a day as long as they're not PURPOSEFULLY harrassing you.""
LOL! Instead of popping onto the internet with your misinformation - you're numbers for the month are low, right? - you should brush up on the FDCPA. You should pay close attentionsto Sections 804, 805, and 806.
""2. Your bank will be able to give you a record proving you made a specific payment to West Asset Management and you can obtain a settled in full reciept from the original creditor. ""
Agreed, except I doubt that such a letter will be forthcoming from the CREDITOR because you folks are not going to give the full payment to the creditor-your agency will deduct their collection FEE (usually a percentage of what is collected) from the monies the debtor paid. Therefore, as far as the creditor is concerned, the debt is not satisfied and the creditor is free to go after the debtor for the remaining balance. You don't tell folks this, do you? This is why consumer debtors should deal DIRECTLY WITH THE CREDITOR and not give you folks a dime. Thank you for confirming what I've been telling folks for decades!
""3. You can't report it as fraud with your bank. You gave them explicit permission to debit a certain amount of funds from your bank account to pay on a debt you owed. ""
They can report it as fraud, but they won't be happy with the outcome and possible legal remnifications for making a FALSE claim of bank fraud.
""4. West Asset Management does not BUY accounts. They collect debts on behalf of the original creditor."" Let's not mix apple and oranges here. There is an original creditor, and there is a CURRENT creditor, depending on whether the bad debt has been sold. Your agency might not purchase bad debts, but are you stating that your agency would not collect for me if I contacted you to collect on debts that I have purchased? - I'm the current creditor.
""5. West Asset Management is NOT a credit reporting agency, and therefore, dos not have access to you credit report and cannot change anything on it. The original creditor, in this case, the hospital.""
You're correct- your not one of the 3 CRAs, but does your agency subscribe to the CRAs? I don't know of ANY collection agency that DOES NOT subscribe to the CRAs - most agencies check the credit history as part of their process to determine if it's worth their time and effort to contact the debtor at all.
""6. If you filed a dispute with the hospital and they found the debt to be valid, it is NOT in dispute. West has nothing to do with disputes other than forwarding your dispute to the original creditor. If the hospital found it's a valid debt, it is such to West as well.""
ANOTHER CONFIRMATION of what I've been telling folks for DECADES. There is no purpose for any debtor to deal with a 3rd party collector EXCEPT for 2 purposes:
1. To obtain complete contact information of the CURRENT and ORIGINAL CREDITOR so that the debtor may deal directly with the folks who have the authority to ABSOLVE the debt, without paying (directly or indirectly) any 3rd party collection fees.
2. To set the 3rd party debt collector up for FDCPA violations leading to a successful civil suit against the 3rd party debt collector.
The debtor will get quicker (and more accurate) results by dealing with the CREDITOR.

#2 Consumer Suggestion
Education for MEG, the debt collector. More bad advice from a bottomfeeder.
AUTHOR: Steve - (U.S.A.)
SUBMITTED: Friday, March 28, 2008
To the victim / debtor,
Stay off the phone!! Never call, or speak to any third party debt collector on the phone!! NEVER do this, as it will NEVER produce positive results for you, as you found out.
And, NEVER pay or agree to pay a third party debt collector!! ALWAYS just sebd CEASE COMMUNICATIONS and wait for them to sue. Most won't. And, most important, NEVER give any bottomfeeder your banking or employment information.
Give them nothing. Deny everything.
Now for the crackhead,
First of all, a collector cannot call as many times as they want to. Both the FDCPA and state laws forbid this. It IS considered hasrassment. Many states limit calls to once per day. And the FDCPA states that a collector cannot "cause the telephone to ring repeatedly with the intent to annoy or harass". *Well, if the first call was not answered or returned, that means any subsequent calls are solely to annoy or harass, right?
The "debtor" never has to prove anything to a bottomfeeder! It is YOUR job as the bottomfeeder to validate a debt BEFORE contacting the "debtor". The ENTIRE burden of proof is on the collector. Heres an idea. Just file the lawsuit! Then you can be sued for damages for a frivolous lawsuit. I love those, they are easy money!
Actually West Asset Management DOES buy accounts. However they buy them through an AKA, and then WAM collects for them, but they are the same owners.

There are multiple problems with your complaint...

7. No one AUTHORIZES anyone to put any account into collections. That's at their discretion and they do NOT need your permission to do that. If people could say 'Oh, I don't want that in collections, you can't put it in collections,' why would anyone have anything in collections?
