I have a medical condition that caused me and my husband to miss several days of work in August. My doctor took me off work due to my medical condition from 9/8/06 12/16/06. We could not make our mortgage payments in 9/06 and 10/06. We were receiving more than 20 calls a day from HSBC which were from some very rude representatives. We were finally able to speak to one that was very nice named Jackie Dockson who was very helpful to us. I advised her that I contacted HSBC on 9/21/06 to advise them we had a hardship. I faxed on 2 different occasions all the medical documentation, bank statements and utility bills with receiving no response from HSBC Hardship Dept and it was now 10/26/06. She advised me that they denied the hardship. I asked why with all the proof that we don't have an ability. She didn't know why but stated she will resubmit the info for a rate modification. I advised her that my mother moved in with us to help with the children for a couple of months so my husband could return to work and we would be able to resume payments for 11/06 as we were able to borrow enough money.

We made our payments in 11/06 & 12/06 but, unfortunately my employer decided to terminate me due to my medical disability effective 12/19/06 and advised me to not to come back to work on 12/16. I contacted HSBC to notify them of this situation on 12/30/06. The first rep named Michelle Dupri was very rude and advised me that we needed to make payments as we are late and our rate modification was denied. After going back and forth arguing, I terminated the call. We met with a realtor to sell our home who advised the market is low right now & to ask our lender if we can do a short sale & to see if they would settle the $70K difference that would be owed due to our hardship. I contacted the Loss & Mitigation Dept with HSBC to see if they could do that especially since we have been loyal paying customers since buying this property until the recent unforeseeable circumstances.

I spoke to a Jeff Davis (very very rude) who told me we would have to meet some strict criteria for a Short Sale and even then we would have to pay back the difference as they wouldn't settle with us. He insisted on knowing why we had to sale as they approved our rate modification to lower our payment by $500 on 12/30/06 for 6 months. I advised him that Michelle Dupri stated we were not approved and $500 was not that much of a difference. I asked him about the other hardship programs that were listed on their website and he stated those don't apply to us. I asked what the reason was as I am still disabled (my doctor has extended my disability) and I have been terminated therefore my husband can't make the payments on his own. He stated if we didn't pay 1/07 we were going into foreclosure. I asked him to transfer me to his supervisor as he was talking to me like we are deadbeat customers. He told me we have always paid late on our account. I advised him payments were being debited out of our bank account monthly since we started this mortgage on the 11th of each month which was set up by their loan officer and we never had late fees. Jeff stated it is late if we aren't paying on the 1st of each month & that the 11th is just a grace period. I demanded his supervisor again; he put me on hold for 1 second coming back stating she wasn't available. I asked for her name & requested a callback. He stated her name was Linda Slater.

It has not been 3 days & we still haven't gotten a call back. This large corporation know they can do a short sale and settle off the difference. We should not have to receive a bad crediting rating when we have been good payors for years. I havent even started on their high interest rates and ridiculous fees.

HFC/Beneficial has a habit of forging signatures and filing falsified Deeds of Trust on properties. This is the basis of many class action and individual lawsuits against them...all WON by the plaintiffs.

Look at the signatures on the DoT they files in the deed Vault of your Courthouse. This is FREE, and very easy to check. If the signatures are not yours, make a copy of it, and take that to an attorney.

They cannot foreclose on property they have no legal claim to. The DoT is their legal claim. Forged signatures do not give them a right to your property.
