To Whom It May Concern:
I wish I would have found you earlier. I could have saved my home. I thought we were all by ourselves. I really thought it was my fault. I want my life back to normal. I want my hair to stop falling out. I want to sleep at night, sleep without taking Xanax and waking up in the morning without taking Prozac. Is there really help out there? Can I save my house by next week? I do believe in Karma too. But being a strong catholic, I pray for there souls. Help!!!!!!!!!!!!!
I can not believe, how mean, nasty and unfair some people are. We have no where to go. We now have been served papers to be evicted. Come next Thursday, we need to be out and we don't have a place to stay until the 1st of September. We've tried bankruptcy, investors, refinancing and turning to a company that helps people out of foreclosure. I was just told today, that there is nothing they can do to help us now. That they tried everything.
I am tapped out in our financial department. But I would love to stick it to them where the sun don't shine. I say let's sue!!!!!!!!!!!!!!!! I think I have a little bit of fight in my left.
My story -
After eleven years working at Safeway, Sammy lost his job in January 2001. In February 2002, my son Brandon started complaining about a very large lump on his wrist that was hurting him. Well, we did not health insurance. The doctor believed that it was a Ganglion Cyst. But because bone cancer is in my family, the doctor surgically removed it. For months, my son had to go through physical therapy. In late March, Sammy was accepted in the apprenticeship program with Pipefitters Union. Sammy is going to school for his Journeyman license and working as an apprentice for Truatman & Shreve. Sammy is guaranteed his job because of the program he is in with Piperfitters Union. The following January 2003, my daughter was admitted in the emergency for an asthma attack. They ended up admitting her in the hospital for three days for a clasped lung and pneumonia.
For several months, I was able to keep up with our mortgage payments. Until all the medical bills, piled up. I tried my best to do the best I could.
March 2003, Fairbanks helped us with a Forbearance Plan. The plan stated that I would put $8,000 down and we would pay $1,425 until September 6. Then the remaining balance of $11,000, would be looked at if we pay in full or if we payed on time, they would look at other options. In June, our loan was bought out by GMAC and out payments would have to go to them starting in June. In mid July, I called and talked to Marie Thompson. She informed me that we could modify our loan with an extention. With the modification, she saw no problem with us qualifying and we could probably get a lower interest rate. She said probably around 8 to 9 percent. She also said that our loan would be written and the remaining $11,000 would be attached to the end of the loan. She let me know that it would be best to call back in August because July was still too soon for them to notice if I have been current. They wanted to see if August would be on time like the other months. In the middle of August, I called back to talk to Marie but she was longer in that department, they connected me to Brian Debuccio. I left him several messages. A couple of days later, I finally got in touch with Brian and talked with him regarding what Marie had told me. He said that she was correct and connected me with Amy, who was in charge of our account. I talked with Amy for quit awhile regarding our situation and our finances. She faxed me a copy of the Financial Analysis that day, which was August 29. She said that if we hurried up and got the Analysis faxed back to her, she could get it processed and I wouldn't have to make a payment until October. I did just that. Mean time on September 1, I wrote a letter to our Credit Union. We have a truck loan with them. I did inform them, that our mortgage company was modifying our loan and if they could modify our truck loan. They approved it and now we have lower payments. On September 19, I tried calling Amy to see how things were going. I couldn't get through to her. So, I faxed her letter that same day that I need to talk with her. Then in the last part of September, I received a letter from a Jeffrey Roper asking me to call him regarding several options. I called him and left several messages that I had started working with Amy on a Modification. I never heard from him. Then I received a letter on October 5 from an Asset Manager regarding possible alternatives available to avoid a foreclosure. When I called, they connected me to a Michelle. I left several messages every day that week for her to call me and never heard from her, either. Next thing, I knew, a Kelly Shea sent me a letter stating that our file had been referred to her to workout an analysis. By the time, I got a hold of her. She refused to work with me. I asked her why and she said that she didn't need to give me explanation. I tried to explain to her that I had been working with Amy since August and by the time I got to her, my loan had been passed to three people. She then, said that if I would put down $3,000 and my payments would be $2,000 on the first of each month. I told Kelly that I would not be able to do that. I hadn't received my promotion and my raise yet and I didn't know how much I would be getting. There were several times that I tried talking to Kelly and she refused to listen to me. She was very mean and nasty and told me that she didn't care. In August 2003, I only owed $11,000 and I had people working with me and understanding of our situation and willing to work with us. With Kelly not willing to work and even listen, I feel that she has put me in a $50,000 debt.
All Sammy and I really wanted was a second chance because our finances coming are the best ever. I would like to ask if you could please take my situation that was beyond by control and help us. We do not want to loose our house. I did try my hardest to keep everything in control but I believe with my raise, and my promotion will go through and Sammy's big raise, we can get make it.
Our house was foreclosed on, on December 15th, 2004. And now this Monday, February 28th, we will be homeless. We can not find any one to refinance us to get the note back.

Daniel,
It took awhile to figure out what you were advising.
The type of deed you are apparently referring to is a QUITCLAIM deed. Anyone who calls it a "quick claim deed" is not someone to take advice from. Quitclaim deeds are not usually deeds of conveyance and the use of one in this situation would have been inappropriate.
The idea of having someone with better credit buying the home from you and allowing you to stay as a renter is pretty hard for most of us to do.
Getting a forebearance from a lender is fine if you have a temporary situation that you know will be resolved in the near future, but if you don't see a light at the end of the tunnel it is time to sell the house and avoid foreclosure. This website is full of stories from people who tried to keep a home they could not afford anymore and nearly every one seems to end with a foreclosure.
I faced a similar situation a few years ago and put the house up for sale rather than risking foreclosure. I walked away with money in my pocket and credit intact.

nadine first i dont know what kind of judge you had but hes wrong any judge can make the decision if he see there is enough evidence
as far as the quick claim deed if gmac has not claimed the home yet ( it has not been foreclosed on notice given to you to move out) you have the right to sell the home to anyone you want to this is what i had to do so they couldnt get it and i would lose all my envestment so this is what you do
if your home is worth $100.000 or you owe gmac this amount plus all their bs add on stuff sell it to your parents for $130.000 dont worry about the payoff amounts (do this through a title company they will be able to get the pay off amount)then have your parents get financing for the amount sell it to them they will have closing costs and they will need down payment money so say these figures come to about $10.000 so after the sale you may walk away with about $30.000 then give your parents back the 10 grand you may still have 20 left to help you through this tough time and to help pay the mortgage for awhile
i may have left out a few things so do the math before you settle on a sale price (exp taxs insurance etc)
so now you will have solved two problems
one you get gmac off you back
two you get to stay in your home because your parents now own it (so dont screw up any more)
what this means is you pay the mortgage for the new loan
hope this works for you and its not to late
i have my next court date sept 6 iam hoping the judge sets a trial this time

We did go in front of the county judge and presented our side but he said that he didn't have the authority to make the decision to reverse the foreclosure. I heard that I can go in front of a district judge but I don't know what I need to do next. I don't know where to turn to now.
We did try getting the loan in our parents' name but GMAC would not communicate to give us the payoff. The loan was approved before the redemption period. Also, how can we quick claim deed to someone else if the GMAC already has a deed in their name.

Daniel knows what he's doing and I would listen to him directly.
But, with my case GMAC has been charging me too much for my escrow account, and I have no clue where close to $5500.00 has gone in less than three years.
If you want to hurt GMAC where it hurts, even if your home is already gone, do the math yourself! Find out Taxes, Property Insurance, Mortgage Insurance (I pay that, but have none proven in writing from HUD)plus the "cushion" GMAC charges (MINE IS 2.20%) Add up the total, divide by 12, then add this to your P&I.
According to HUD, anything over $50 per year must be returned to you.
As with my case I've been charged about $1900.00 per year to much which GMAC claims I did not.

sorry you have to deal with gmac this way but its just typical for them
heres what you can check into doing to save your home
1 find out from the clerk of the courts in your area about geting a quick claim deed on the house put it into a family members name
2 have a family member buy the home from you for just what you owe on the mortgage and any other hidden cost example if you owe them 10.00 sell it to someone you can trust for 10.00 they let you stay there and keep paying the new mortgage then when you get back on your feet buy it back from them for the same amount you should sighn a contract with them stating this is what you are doing have an attorney do it for you
remember you still own the house until the end also oyu did not mention that you have been to court yet did you go before a judge and tell your story and if not why havent you been yet hope this helps
