Help!
I received a summons to appear to file for a court date. The summons is from a law firm representing midland funding. They attached paperwork including a complaint that I owe 3550.69 which was purchased from a credit card company and a form 409 from illinois from Elizbeth Neu stating an account number and dollar amount that I owe...it is dated on dec 7 of 06...but I never received any correspondence from them. I paid my fee and received a court date which is tomorrow and basically I need advice on what to do. I consulted with a lawyer who stated that unless they can produce a signed contract stating that I agreed to owing the money that they cannot legally pursue me for it and the judge will throw out the case. Is this true? Is this what the court date is for ....to get the judges permission to pursue me for the money? I guess what I need to know is.....do they have the appropriate paperwork to prove I owe the money? Sorry if I sound like a rambling idiot, but Im not sure what I have gotten myself into. Should I even show up for the court date?

You write that you consulted an attorney and then you ask HERE if you should go to the court proceedings?

Your attorney should have covered this when you "consulted."

You should definetely attend so that they don't get a default money judgement against you.

MORE IMPORTANT - find a different attorney to consult with!
