Second, the recent Supreme Court decision, while certainly disagreeable, set forth no new law. It merely affirmed the validity of existing laws, and reaffirmed the holdings in previous Supreme Court cases.

I don't agree with the holding, but I can at least be objective about it, and form predictions of its effect that are grounded in 21st century reality, not Orwellian fantasy.

The concern about this case is that it seemingly expanded the definition of "public use" for eminent domain purposes. That may be the truth, but state and local legislatures have been operating under this so-called expanded definition for decades already. So instead of there being some kind of big change as a result of this decision, the truth is that the status quo will merely be maintained.

Even if the recent decision had restrained the definition of "public use" to that as clearly set forth in Hawaii Housing Authority v. Midkiff, decided in the 80's (a definition clearly contemplated by the Consitution), none of your predicted "evils" would be prevented (i.e. privatization and foreign ownership of public facilities). All of these specific events would have been possible and virtually uncontestable under prior precedent. The new decision simply affirms that "public use" can refer to a private establishment that is "open to the public" not in the sense of a park or library, but in the sense of a grocery store or movie theater.
