I found out my identity had been stolen when I received a credit alert from Truecredit showing that First Premier Bank had pulled a copy of my credit report. Since I don't do business with them and hadn't applied for anything with them, I called the credit bureau. Someone had applied for a credit card with First Premier using my name, ss# and date of birth, but a different address and phone numbers that were not mine.
I immediately called First Premier Bankcard expecting them to be glad I caught the ID theft so quickly. (Called them one day after it had been pulled) They were not helpful! I asked for the "identity theft division." They don't have one. They have a security department that they won't let you speak with. The customer service reps won't help you. They even wanted me to give them my correct address and phone numbers for the application and were angry when I refused.
I told them I had already placed fraud victim alerts on all three credit bureau reports and had called the sheriff's office to do a report. I asked them what I needed to do in order to request the information on the application so that it could be investigated. Over the course of several days, I was told my at least 10 different employees of First Premier that there was no way for me to request this information. I was told that my local sheriff's office would have to issue a subpoena.
When the sheriff's investigator called me, I informed her that they wouldn't cooperate and she would have to subpoena the information. She did and a week later received a letter back stating that they did not accept subpoenas from any state except South Dakota and that the victim would have to request the information. That's exactly what I wanted to do and was told over and over that I could not do.
They have ignored two letters already and they are horribly rude when I call. I am now sending the letters and other information by certified mail, return receipt requested. They won't give me a time frame on getting back with me and they won't remove the fraudulent inquiry from my credit report.
By refusing to help the victims of identity theft, they are aiding the criminals and making it harder for law enforcement to apprehend them.

File complaint with the Office of Thrift Supervision

Credit card companies will ignore valid complaints - but they cannot ignore them when the Office of Thrift Supervision is involved.
I have resolved 2 different issues one with WAMU and one with GEMB by having the Office of Thrift Supervision handle it. In both cases - no one at either CC company would even discuss the problems with me at all.
www.ots.gov - You can submit the complaint via email. Print the email and sign it and then fax it to them with copies of all the letters you have sent requesting information and the police report.

It's now been well over a year that I've been fighting to get my ID theft cleared up. First Premier is still refusing to provide any information to law enforcement. I've repeatedly sent letters to First Premier telling them to remove the fraudulent inquiry from my credit report and they ignore them. When I call customer service, they will not transfer me to anyone that can help me and keep telling me to send or fax a letter. I've told them that I've sent at least 10 to 15 letters and I do not receive a response and they do not remove the inquiry. I've disputed the inquiry with the credit bureau and when they investigate, First Premier claims they had my permission to pull my credit, so the credit reporting agency will not remove it either. It's extremely upsetting to know that anyone can pull your credit report and even when you've proven that it was identity theft and prevented the company from losing money, they still insist on helping only themselves and refusing to help you or undo the damage they've done.

It took months and months to get the fraudulent credit inquiry from this mess off my credit report. I haven't checked in a couple of months, so I thought I'd be sure nothing else has happened with my credit reports. I pulled the Transunion account and found out that First Premier Bankcards original inquiry on my credit report has been placed back on there. Apparently, the victims have no rights whatsoever. First Premier is so slimy protecting the criminal by refusing to provide the application information to myself or law enforcement to assist in the investigation. And now, they are refusing to remove the illegal inquiry. I would love to know what kind of company goes out of their way to torture the victim of identity theft. What's the worst about it is the fact that I saved their company money! It's because of my own diligence in monitoring my credit that I contacted them after their inquiry and before they issued a card. If they had issued the card and the criminal had used it, they would have been out that money. How did this company reward my diligence? By mistreating me the whole way through and refusing to help myself or law enforcement by providing us with the information the criminal gave them.
And then their employee has the nerve to write that it's law enforcements responsibility to investigate the crime. BUT, law enforcement needs the information from the application. All they have is that my identity was stolen and an address that isn't mine. They have been monitoring the mail at that address and the activities there. The only resident is a very elderly woman. They have absolutely nothing to go on because First Premier Bank would not cooperate. A company that isn't willing to help the victim is scum!
I'm not going to let this go. I'll be contacting the FTC next week to file complaints with them about First Premier Banks refusal to cooperate. If I have to, I'll call a lawyer and sue them for the information. But if it has to go that far, I'll sue them for everything they've put me through. I think considering how bad identity theft is now and how anyone could be a victim, a judge isn't going to look to kindly on a company refusing to provide the evidence that is needed to prosecute the criminals.

The police cannot investigate without additional information from First Premier Bank in regards to the application from the criminal. First Premier Bank refused to provide the information to law enforcement and said that I, as the victim, would have to request the information. I received a letter from First Premier Bank saying that because no account was opened (thanks to me catching it and reporting it to them before they opened an account) I do not qualify for the information under identity theft.
Then, since I reported that the application was not done by me, it would violate the criminals privacy to provide me any information in regards to the application. So basically, they will not provide me with the information and the police have nothing more to go on except for the address and disconnected phone numbers that were used on the application that was only provided to me by TrueCredit. The only reason First Premier Bank won't help is because they aren't out any money and the only reason they're not out any money is because of my diligence in checking my credit report and immediately notifying them that they pulled my credit when I had not applied for anything.
As usual, the criminal is being protected by First Premier and I'm being prosecuted. The application was done online and the police could really get something done with a captured IP address, but First Premier is protecting the criminal and will not help me or the police to investigate this crime. They should be charged as accessories for allowing this to continue.

I apologize that it was handle this way. Here's how it should have been handled. Once you called us and stated that we were showing up on your credit report and was never applied for, the first thing needs to be done is to file this as a fraud account. If they were able to verify other information with you and the address and phone numbers weren't yours, it is our job to get this information updated so that our security department can send you notification of that the frauduent account was taken care of. Also, your correct phone numbers in case if they need to get ahold of you if they need any further information regarding of the account applied for in your name. Once the account is reported as fraud, the account is closed, any fees that were charged on the account are credited and it is removed from your credit report. That's great you filed a police report on this, but it is not us that can go after the person who used your identity to apply for our credit card. The police handle this matter and it's better when prosecuting someone that it is left up to them, not you trying to find out who did it. We want our customers that this happens to be as cooperative as possible so we can get the job done and so it does not affect you negatively. If the information is given what we need to close the account down as fraud, it's over and closed. How far it goes with police is up to them what they come up with for you.
