I'm amazed we have all the time to create NEW Bills, Laws, Statutes, Acts, etc. Yet to ignorant/incompetent to enforce the ones already in place. And yet we consumers are considered the "UNSOPHISTICATED" Most unsophisticated possess COMMON SENSE. We need to ENFORCE THE ALREADY "STRICT LIABILITY" ACTS, etc. ALLOW/ENFORCE, CITIZEN RECOVERY. Without $5000.00 (or MORE) for a retainer or the lack of an attorney license, citizens receive no recovery, dignity, direction, etc.

DID SOMEONE JUST TURN PLYMOUTH ROCK OVER. Possible reason for filing bankruptcy-maybe?? But my unsophisticated common sense opinion, is that we are wasting time, energy, our taxpaying unsophisticated dollars passing new laws etc. in RE of bankruptcy (I realize their are irresponsible consumers). While in the hell can't we finish something started? Accountability is the new trend.. So all, to include, lawyers, judges, representatives, governors, senators, banks, debt collection, real estate, state & federal employee's, law enforcement, AND of course the unsophisticated, etc. need/must realize nobody is above the law. With the, (close) unconstitutional rules, laws, bills, etc. being brought about leaves citizens with no other alternatives but to investigate their attackers skeletons (POSSIBLY YOURS) and obtain knowledge-POWER. A matter of survival. Quite frankly, after the American Spirit has been attacked and destroyed many times over, you leave them with nothing to lose. But, maybe you do??-HUM.

I HAVE IN 2 1/2 YEARS CONTACTED ALL AND ANY SUPPOSED TAXPAYING GOVERNMENT ENFORCING AGENCIES AND AFFILIATES TO KNOW AVAIL. My personal exhausting documented list JUST KEEPS GROWING. Responses consist of "You need to contact SO & SO" or "Really Sherry, What do you really want?" Maybe my dignity,etc. In my travels only coming to dead ends, my unsophisticated perception to tones, sighs, higher pitches, etc. was first humiliation (ignorant so to speak of to the law. I was only introduced to Webster's dictionary never the Black's Book. BUT in 10th grade (1975) I was introduced to sex education. JUST A BLONDE THOUGHT), disbelief, anger, frustration, depression, etc.-THEN KNOWLEDGE. Just one day it would be nice not to have to defend my character within that 24 hour period. The beatings, being run over by a truck, going through a windshield, cancer operations, etc. allowed the opportunity for Demoral &/or Morphine. Nothing can explain the retched pain of inner being loss of the SOUL. With all the violations I personally have experienced, I will be diligent. Recovery for me personally, family, husband, mother, business, loss to business, the four attorneys (restoring faith-ethical exists), etc. Fulfill goal for a nonprofit directional Center. And execute awareness to these bad faith unethical continued abuses, sparing even just one family. MY SPIRIT WILL PREVAIL!! Money is replaceable we are not.

And of course it would be understandable that you would not want to go forward with this execution of awareness from an Unsophisticated Consumer. At times it maybe a bit confusing-but please read bewtween the lines. And remember I am not a secretary (lack of format), for i gave up pantyhose along time ago!!

While viewing keep in mind these occurrences I have xperienced. I have been run over by a truck, went through a windshield, live with cancer, beaten beyond recognition, recent airbag's that deployed on my husband and I ( 200 mile an hour impact) no diagnostic reason or collision, WI. officer's on my property repossessing loaner vehicle supplied while repairing &/or diagnosing airbag deployment, vehicle purchased 6 days prior to deployment-WI officer's had no paperwork-no judgment-no replevin-no stolen vehicle report etc. which would constitute a repossession of $20,000. MN licensed vehilcle, to date no police report (informed no officer's on my property-HUM), nervous breakdown, MN business audit 99'-00', debt collection agency seizing account-no judgment filed-money order receipt dated 8 months prior to seizing debt paid (NO due process procedure), bank allows this seizing of property, I close bank accounts-yet reported (to a ChexSystems-mafia of the financial world-affecting OVER 4 million people every year-no accountability, ever) they closed it-FCRA violations, MANY MANY MORE.

SO-My point is, I REALIZE I AM ALIVE FOR A REASON. AWARENESS IS NEEDED NOW AND KNOWLEDGE IS POWER. I pray all take this seriously for the avenues of destruction are many and last for years. God has granted me Serenity, Wisdom, and Courage (& attitude).

To Whom it May Concern, 4/01

I am in need of a mortgage, direct lender, investor, etc. I/we have been victims of bad faith procedures. I purchased 10 acres with an A-Frame, one hour commute from Twin Cities, and 1/4 mile from St. Croix River 3/99. Beautiful with great potential. I am the President of Pet Pro's Center Inc. in Coon Rapids, MN, and my mother, Janice Warren (best friend) being the Vice Pres. We, to include our crew and family, have all worked VERY hard, with combined entrepreneur ship of 30 years to get where we are (or was). Recently mentioned as top in MN for integrity, knowledge and family atmosphere (in this industry this takes HARD WORK, bleached hands, going the extra mile, & the ability to realize the all mighty buck is replaceable WE are not). The intent for the 10 acres, home, but more important our Venture Project for future and expansion. This consisted of building a Pole Barn, distribution manufacturing of parrot stands, toys, cages, etc. This would allow for the importing of actual Brazilian, Australian, etc. hard woods & accessories needed to produce quality products. Goal, to produce the best in the nation.

Making a long story shorter, we/I have been victims of bad faith mortgage/real estate procedures. Highly bordering Predatory Lending. 3/99 my credit score was = to 628, recent violations by mortgage company, Eagle Valley Mortgage (Banks MN, also) Hudson, WI., in credit reporting (FCRA violations a "STRICT LIABILITY" Act, or congress intended it to be) Score now is = to 538. FULL annotations exists, I assure all!

Real Estate (Tom Nielsen-Coldwell Banker/Burnett Hudson WI.) violations include but not limited to: slamming, no code-inspection-lead base etc. reports available, "why would the agent co-sign a note to my property?", charged sellers 8% (appalling), no doc's as to who represented seller/buyer, no seller home disclosure statements, etc. (on & on) Represented by Kristina Ogland, Hudson, WI. Ms. Ogland was not present for the closing to include loan officer of Eagle Valley Mortgage that worked on details (hum), which is no longer employed at Eagle, etc.

Mortgage/Bank company brief violations include but not limited to: 2 yr. balloon Arm (understood 5 yr.) Conventional Uninsured-which for business purpose needed (clear intent) to show proof of 20% equity (future business loans), that is why I put so much cash down (not the apparent case), extreme differences in Good Faith Estimate-Truth In Lending, no 3 day review allowance produced, statement proof-to late fee charge errors, promised a roll over to fixed after one year-no avail, discrimination violations, President-Oseby allows for time to have continued conversations w/Nielsen, agent in RE of my property & NOT me. What is the possible relationship between Eagle Valley Mortgage & Coldwell Banker Burnett/Nielsen-Bob Nicholson President/Vice President? (opinion-thought) Their attorney Mr. Loren Solfest (who actually I feel is a nice man, just in the wrong line of his practice) of Severson, Sheldon, Dougherty & Molenda, P.A. Attorneys at Law Apple Valley, MN, can not explain this one either. Although the attempt for clear answers exists with this firm since 8/00-NO AVAIL, no credit worthiness check on file for Nielsen, 2nd mortgage errors, no 3 day AGAIN, no Truth In Lending-Good Faith, husband cosigned responsibility with no creditworthiness check-no 3 day viewing, no signature of acknowledgment by husband on Conventional-1st mortgage, real estate agent-no proof acknowledged to 2nd mortgage (2nd mortgage=small business loan & if provided accurate into to business loan, & that this was a complete 2nd mortgage issue most assuredly NEVER would have followed through. would have secured a fixed mortgage prior to EVER a 2nd mortgage.-HELLO), accordingly with recent discovery "Why would a National or any company proceed with a second mortgage (red flags) in RE of 120% LTV?" My, my that loan officer no longer works for EAGLE VALLEY either-Hum again! Started 4/99 asking for copies of appraisal, 3 day viewing notices, new Truth In Lending & Good Faith Estimates (explaining cost increases at closing & different loan) lack to comply with request for copies to inspec-code-lead base proof (Offer to purchase reflects my concerns, as Agent x'd that these are available upon request), reasoning of co-signer of real estate agent, etc.-no avail (received copy of appraisal 2/01-WHY THE CONTINUED MYSTERY in presenting continued commands for documents?), to date-NO AVAIL., Cashing of a 9 day stop payment check (account debited 20. fee & signature verification by me/Pres.) for $1500. (check not endorsed or made payable to person funds were handed over to), $10,000 loan approved 6/15/99 yet only $5000. provided on 6/18/00 and remaining $5000 on 8/11/00, obviously we assumed the whole $10,000 would be provided especially since interest and complete collateral existed the date of signing-6/99. We/I have asked several times for a meeting (customer service) to provide all concerned, understanding and an opportunity to resolve concerned issues-NO AVAIL. Unable to get the correct amount of a default documented, or due date. NUMEROUS refusals to payments (refused payments in trust) they have had to sign for. Cash payments made in person with witnesses, not applied, etc. Reaming discovery for Counter Claims-WI & MN.

Mr. Oseby, President of Eagle Valley Bank, assumes I feel he wants my property, although this is an entertaining thought & flattering, I am not (now) that naive. I truly believe they are completely IGNORANT and/or INCOMPETENT (both) or just how many other consumer's have fallen under these bad faith procedures.Truly Eagle Valley to include Mr. Nielsen benefit highly from all moneys received, maybe? Thoughts to these aspects are continue to plague and frustrate me, for consumers are often to exhausted and as mentioned many times "unsophisticated" to the laws, rules, statutes, FCRA, FDCPA, Public Laws (Common), Securities & Exchange, Truth In Lending, Fair Housing Protection, Consumer Law Protections, Statutes, Rules, OCC, FDIC, FTC, US Treasury, HUD, Fair Billing Act, discrimination protections, Tort, Bad Faith, etc. involved. They prey on our (consumer) continued ignorance.

These bad faith, procedures has resulted in the destruction to obtain a new mortgage. Which Eagle Valley Bank N.A. would/could have been paid in full for all moneys owed twice 8/00 & 3/01. But Eagle's & Agent's continued lack to provide documents & corrections made completing fixed mortgage (pre approval was in place) impossible. The only way to get results & opportunity for defense is to let this go into foreclosure. This will make ALL discovery by Eagle Valley and Coldwell Banker Burnett a discovery process & will go in front of a judge. Quite frankly, they have left me with nothing to lose, for the destruction already exists. My goal DILIGENTLY is recovery personally, & for my mother, husband, dignity, business, pride and MOST of all the assurity they will not be allowed to continue with bad faith procedures to others, which clearly destroys all. Clear Tort issues-intent/neglect-HARM!! We/I diligently will fight for justice, execute awareness, and obtain ALL and ANY recovery allowed by law. To date this has destroyed credit, family, home, business, mother, defamation to me personally, business, dignity, health, losses approx. to date over $50,000., loss to Venture Project & moneys loss pertinent with that venture, and loss to many, many hours of work, attorney's fees, long distance phone bills, etc., not to mention abuse to our character & American Spirit.

If a/your company can help us establish a mortgage (secures venture project), it would be greatly appreciated. If this request plays no relevance, pure intent is awareness, accountability, etc. I have provided brief details as to what we have been up against, re credit report reflections (Eagle Valley has offered to correct the reporting issue to bureau's, yet excuse, "want to see my report" well pull it idiots. Stop wasting our/my valuable costly time with such continued ignorance. Payment in full 3/12/01 was in place. I now am calculating accrued interest to daily losses, violation recovery, fee's etc. to include personal, husband, & business (defamation, etc.) Eagle Valley Bank is currently in DEFAULT).

Income verification will prove approximately $3000. a month. Property- House value approximately $110,000. with Eagle Valley pay off of 1st mortgage $63,700. & (unethical) 2nd mortgage $14,700. ( less the $1500., & costs to date on the stop payment issue) = $78,400.-1500.-1500. (actual cost) =$74,400.payoff. I am asking for $95,000., of course first to pay off Eagle Valley (NEVER will I/WE stop the recovery process-not this time,Counter Claims) the remaining funds would finally for the Pole Barn (distribution-Venture Project forward) to be built. This will increase value of property considerably-to approx. $125,000. or more considering the growth in this area. 3/99 when I purchased property 10 acres was going for approx. $15,000. now worth approx. $30,000. to $32,000. (WOW) I'm assuming because of the convenient commute to the Twin Cities, the beauty of the area, and being so close to the St. Criox. As you can see LTV would apply as collateral.

Please only serious responses, or offerings of a secured mortgage opportunity. As you know, the process is quite time consuming. With the two pre approval fixed mortgages already processed for payment to Eagle Valley, has wasted many a day/hour. Email sherbare@grantsburgtelcom.net.
