MRC Receivables Corp - Steven B. Mulrooney - Mapother & Mapother, P.S.C. Filed a lawsuit against me to garnish my wages and won. I had no idea this was happening or who they are until I received notice of the garnishment in the mail. Louisville Kentucky

I received a Suggestee Execution in the mail stating that I had been sued by MRC Receivables Corp in the amount of $2,126.86, and that they would be garnishing my wages.

I had no notice that I was even being sued and I have no idea who these people are or who they represent. I made a telephone call to Steven B. Mulrooney's office listed on the back of the document. I was told by the woman I spoke to that I would have to get a lawyer. I don't have money for an attorney and I don't know who they represent. The names they have listed for me on the first line are me, but the AKA: Sharon Gill is not me.

My sister has a history of credit card fraud against family members and she used to be a Gill.

I could really use your help. I cannot afford an attorney, these people would not give me any information and I cannot afford to have my wages garnished for a debt I did not incur.

It is apparently possible to be sued in Jefferson County, KY without being served! My husband is indeed having his wages garnished by this company, and was never served. He unfortunately let this go on for some time before letting me know about it, and is too passive to fight for his rights. The debt is way beyond the statute of limitations and after reviewing the court documents I've found that the summons clearly states, "Not served" and "House vacant" (because they were attempting to serve to an old address).

Now that he was never given the option to defend himself in court and the collection agency has been successful in getting a judgment and garnishing wages, I don't know how to approach this situation. The company has violated FDCPA and has wrongfully collected money from my husband.

You don't get notice in the mail that you've been sued. An officer arrives at your door, asks if you are ... and then hands you a paper which you let fall to the floor. ( some states this is a valid service).
