The case is also currently listed with the West Florida BBB, via case# 67173945 There were many more email communications that took place that are not included in the Business response that BBB received. Most notably is an email communication from me, sent on 4/20/2010, Where I stated that "have some questions first in regard to your side of the commitment." It is now understandable why the representative was insistamt on discussing these details over the phone. I have the details of each phone conversation, as well as all email records if they are requested. The BoatsExpress representative included only a portion of the words of my termination email in his response here. I actually composed the email very kindly, and did not point out the details of the phone conversation that took place a short time earlier. It was my effort to terminate things on a cordial level, and not communicate that i was still very angry and personally offended. It was not to point out the significant contradiction between the representative's statements and statements made by Greg Hutchins, the company President, whom i spoke to while trying to track the representative down for over 2 days. All of these are supported in email and phone records.
The representative did send me an email diagram of my vessel model. For that, i could justify a $25.00 fee. Beyond that, no work was performed. No company was dispatched. I waited to be contacted by a transport company, as was communicated by the representative. No company contacted me or the marinas for over 30 days.. Even if the representative wants to change the definition of "convenience rate" in their contract after the fact, what does it prove? Please prove where the work that i paid money towards was done. Addressing anything other than this would be nothing more than an effort of misdirection by the business. My personal records are far too meticulous to take such an attempt lightly.

The Quote was sent to Mr. De Vries and he signed the Contract on the same day April 20. ( see attached Contract ). On April 23rd Mr. De Vries advises me that they have made other arrangements to transport the boat. By Mr. DeVries own words he just decided to have another transport company just a few miles away take the boat. He was not satisfied that a truck had been dispatched to pick up the boat the following week. On April 30th I responded that based on the Contract Mr. De Vries signed that his request for a refund has been denied based on the facts that a truck had been dispatched, as stated in paragraph 4 and our Contract that you signed says it is good for 30 days, as stated in paragraph 5.
Here is the email Mr. DeVries sent me on April 23:

Bob, I communicated the information you gave me to the seller. The seller cannot incur any more costs and together, we could not get the commitment we needed from that marina to perform the work necessary. Therefore the seller tracked down a hauling company and put them in touch with me. The boat will be placed in the water instead and moved to the haulers marina a few miles away. The hauler will then transport later in the week. It wasnt that I needed the vessel in Spring Lake immediately, as much as it was that the seller needed to wipe his hands of her. This is also a way to make sure that the topics of loading and unloading are also taken care of.
