Yes, that is true, the former plaintiff is still free to file new lawsuits in the former defendants jurisdictions. 

But.

The judge when dismissing this case also had the option to transfer the claims of two of the former defendants to their home jurisdictions based on the federal rules of civil procedure 21 & 28. The judge considered if the transfer was warranted. He decided to deny the motion to sever, he explained why he made this decision, it was because it was not in the interest of justice, he also stated that it was not in the interest of justice, because it was frivolous.

When making this decision the judge looked at the complaints individually, he explained in great detail one by one why each complaint would not hold up in another jurisdiction. 

Any normal person would just accept this, they would not be going around throwing out threats of more lawsuits, or writing libelous complaints on sites like this one. However, it is testament to this former plaintiffs character that she continues her petty vendetta against these former defendants. It can only be seen now as harassment because she lost. She and her attorney now face a sanctions hearing, which is based on the fact that the complete lawsuit is frivolous.

Both plaintiff and defendants really should keep their mouths closed until this thing is settled, if the former plaintiff continues to act in the way she has been doing no court will ever take her seriously.

 

According to the court records, the lawsuit was dismissed from this court for jurisdiction and the plaintiff is free to file the case in the defendants' jurisdictions if she so desires. I would think both plaintiff and defendants would be wise to use caution in the comments they post publicly.

Firstly, Shanda Lancaster is not a defendant, she was a defendant but the case was dismissed by the judge, not only did he dismiss it, he also deemed it frivolous. There are still things going on with this case, both the former plaintiff and her attorney now face sanctions from the court, they are now the defendants in this matter.

When one brings a lawsuit against another person, it is to their benefit that they tell the complete truth in the matter, it is to their benefit that they don't give false or misleading information, it is also to their benefit that they do not go around the internet typing false, malicious lies or have someone do it for them. It would be for their own benefit that they are not seen to be aggravating the situation. It is plain to see to anyone who cares to look, that the former plaintiff in this case thinks differently, she just cannot contain her hate.

When one is involved in a lawsuit, especially the person spending the dollars to do it, it really is not in their best interests that they file hundreds of complaints on these type of sites, it shows that they felt a need to back up their "apparent" facts, it shows a need to demean and disgrace other people, when, if their lawsuit had any backbone to begin with, they would not need to stoop to such low standards. No matter how many of these reports they write about these people, it changes nothing, the case will still be dismissed and the former plaintiff now a defendant will still be facing sanctions. It is apparent that she is ignoring this threat of sanctions that now hangs over her head, she prefers to spend her time writing libelous and malicious complaints on sites like this one.

She is making herself look like a complete fool, unable to stop her fingers from inflicting hate wherever she goes. She obviously has money to burn, as she cannot stop her threats of further lawsuits, even though the judge has told her himself that the outcome would not change.

Every complaint written about these people has been calculated malicious lies, a bid to ruin their reputations and a bid to goad them into reacting in order to give the former plaintiff "something" to back up her lawsuit. It is malicious, it is libelous and it really should not be needed, because if these people were in fact as devious as the former plaintiff has said anywhere she could find to write it, then the judge in this case would not have dismissed this case. To carry on threatening and accusing is like saying the judge dealing with this matter has not done his job, he did do his job, he dismissed this case and saw through the former plaintiff. I feel sorry for the attorney now facing sanctions because of her, not only has she tried to ruin the lives of the four former defendants but a fifth casualty can now be added to the list, perhaps she is set on a road of self destruction also, it would seem so. Anyone who knows this woman or is close to her, should be telling her to stop, they should see the potential damage she is not only causing herself, but also to others, or perhaps they don't because they fear they may be next on her hit list, that I can believe. I would urge anyone associated with this woman to leave her to her own devices, do not do her dirty work, it may very well be you at the receiving end when you do not do what she wants. 

All of the time used to write these trash complaints could have been time better spent, what a waste, because in the end, the former plaintiff lost.

you sent holland editing a nasty message by following them to goodreads and saying this person was responsible for 900 posts and reports about you so no.  ripoffhell is not and was never a "general" project

as far as your truths go.  you will have to be 100% correct AND can prove it in court.  every single time you accused someone of something you will have to prove it.  everytime you guessed about this person or that one, you will have to have your attorney subpoena the sites and get the authors information.  you will be wrong each and every time.  no one spending huge amounts of money spend time writing reports.  diane posts in her real name.
you are also shown to attack witnesses that have signed declarations against you by lying about their business.  purposely going to a similar named business and telling the guy holland house STOLE their name and is pretending to be them is a flat out lie and you know it.  what?  you have inside information that the editing company stole this guys name and was pretending to be them?
you will answer for all this in court and no snappy retorts here on these sites will get you out of that one.

as a defendant you must prove anything you have posted in court as the truth.  that job falls on your shoulders.

You started a site to remove sites like this but YOU USED sites like these to smear others.  It was not the truth.

You purposely tried to ruin a business and attacking witnesses in a court case will be used against you in a court of law.

This ripoff report confirms, at least to me, Diane and Judy have acted in concert to smear my reputation.  It seems, to them, their efforts have 'payed off' by the way they seem to congratulate one another and your "Let's get her!" attitude;  I personally see what everyone else sees: two bitter, hateful people set out to hurt another person.

I have never denied making my own reports about Judy and Diane... I've never tried to keep it a mystery as it seems Judy and Diane have attempted to do... I post in my own name and with my own IP address.  The major difference?  I tell the TRUTH.  You can pontificate endlessly about how MY truths are lies but... I imagine your actions and words show the public MY truths are true!

Everyone knows the story by now, Diane.  Your frivolous lawsuit against me and other former defendants was dismissed.  The ruling judge basically called it 'a waste of the court's time'.  I completely agree.

The fact you have begun your smear campaign again clearly shows your hatred and belief that everything is all about YOU.  Why?  Because I opened ripoffhell.com?  Never once did I mention your name until you came onto the site and began to personally attack me.  By the way, thank you very much for the free advertising.  Now more people will read my site and know how serious the issue of rip off reporting can be... it is troubling... it is a form of cyber bullying when used the way you have used it.

You'll notice on ripoffhell.com I post about more than just what was done to me.  People getting caught in smear campaigns is not a new issue nor is it one people approve of.  There are thousands of victims out there... my site is a place for them to be heard.

I do not know nor do I care if you have obtained a new lawyer but... the clock is ticking... I think you should spend less time making a complete fool of yourself online and more time trying to figure out what you are going to do on February 14, 2013.
