I currently have a complaint against Wachovia for the manner in which they apply overdraft fees.  I had two checks cleared with a small positive balance and then had three small debit transactions posted which overdrew my account.  I was charged $175.00 or 5 overdraft fees for these transactions.  The bank says it is because of debit card holds which had not been posted.  The holds were not posted for 7 days and I have found that the funds are not paid by the bank until the transactions are posted. 

I have also found that there is not a uniform policy on returning these fees and that their practices may be discriminatory.  I was told by my local banker that the funds could not be refunded because it was "company policy".  I then called customer service and had a 50% credit applied when I stated that I was going to file a law suit.  I have asked to see the corporate policy and there is nothing forthcoming.  I would like to work to put together a class action suit against all Bank.  Anyone who would be interested in joining please let me know.  I am going to start by filing a suit against the bank in small claims court.

       I am new to this site, having filed my first complaint recently.  I, too, have had problems with banks in the past but in all truth they are to some extant , problems of my own making.  I had one maddening episode of overdraft avalanche @ ten years ago.  I definetly got rooked by a now defunct bank but my lack of bank savvy made the problem worse. 

      In my recent complaint I recounted how I was bilked out of a fair chunk of change by a cramming operation.  Contrary to my own report I did catch it early on and had it dealt with.  The crooks were persistant, and I somehow came to believe the charge was a service fee.  That was dumb.  I didn't remember to ask the right questions and lost money because I was blissfully ignorant of how these things work.  The first step in rectifying any banking issue is to get the facts and be honest as well as responsible.  Accept blame before you assign it.

     Consider too that the people at  the bank are not the enemy and if you are polite and persistant without being obnoxious you may achieve a fair result in the end.  As silly as it sounds to the bank haters, I've actually had some good and fruitful discussions with workers at my branch and in one case, made a new friend, sort of.  If you're nice to them, they may be nice to you, and vice versa.  If you have been treated unfairly, it's possible that they may be on your side.  Don't take it personally.  If you can't get a fair shake, go to another bank.  In spite of all the take overs and mergers, there are still choices available, particuarly for good customers.

     Boy you guys sure had a ball with this one,4+ years.  By the By, be very careful of logging onto the Anti-Fed, anti-bank websites.  They are dangerous sources of viruses and such as well as a haven for whack-job anti-semites.  As soon as you see content about the Rothschilds and the Zionist banking conspriacy, the neo-nazis aren't far off.

     Perhaps a time will come when responsible informed consumers can do business in an ethical sanely regulated banking and investment enviornment.  As it stands now, we could all do a little better.  Let's all try to be a little smarter, and a little kinder.  Let's hope for better times in 2014.

That is the most stupid thing I have read on here in a while. Bank of America just lost a huge law suit for re-sequencing its transactions in order to create MORE over draft fees then would have been created if the transactions were posted in sequence.  Go watch some more Fox News.

Secret Service Poem.

Wells-Fargo did the exact same thing to me. They drop the charges from your register putting the money back in your account then when the merchant closes their batch the charges magically reappear and instantly post.  Your account actually shows more money than you actually have. Wells-Fargo does this on purpose to catch you in over draft fees.

Don't be discouraged by all of the people posting against you. They are paid by Wells-fargo to troll the internet and disparage people with legitimate complaints against their employer. Wells_fargo is a dirty dirty company out of Louisiana. They were bought out and changed their name before they went nation wide. They are just waiting on a law-suit and it is coming.

I can predict..

That the economy goes up and down as well as the stock market and gold prices and gas prices. I also predict for the rest of our lifetimes we will see inflation.. I make a prediction here on this report that once the market bottoms out...(could be 13 months), it will go up again. Dear people of Israel,

The reason that prices have gone up so much in the past few years on things like- food, gasoline, living expenses, etc., is because the Central bankers in America and in Europe have had to inject Trillions of dollars into their economies in order to prevent a Global Depression. There are also others who have been able to successfully manipulate the price of oil which has helped to keep things afloat for the time being, but by manipulating the price of oil, it also causes commodities to go up in price because commodities, such as food, need to be transported by trucks, trains, and planes.

It's always best to be able to understand WHY food prices, gasoline prices, and other prices have soared in recent years. One of the main reasons that prices have soared can be traced to what happened in the United States of America. that taking out an ARM ('Adjustable Rate Mortgage'), or an 'Interest Only Mortgage' was okay, and they'd be able to refinance their homes at an affordable payment with an affordable rate when those ARM's began to 'adjust', didn't they? And MILLIONS upon MILLIONS of people who took out 'equity' in their homes BELIEVED that their homes would continue to appreciate in value, correct?

I do agree many people do not know how to save or manage their finances well enough. Or maybe they work 9 hours a day, commute an hour each way and are tired and pressed for time.. so they eat a 3-4 dollar fast food meal instead of shop..or spend $1.85 on a cup of coffee instead of home brewing..or drinking disgusting tap water instead.

But these same people the bank defenders consistently knock and blame..are the ones the banks are making the most money off of. I do not hear these customers complaining about the price of a Wendys hamburger...or the price of a cup of coffee..what I witness many of them complaining about..is the bank gladly charging them a 35 dollar fee for the happy meal..and the reason the meal was so expensive...is because either the transaction was allowed to be processed even though the account was drained..or due to a manipulation or tactics the customer was unaware of...the bank charged a fee and sometimes many additional fees as well. Since the customer was unaware this would happen..they clearly had no "intent" of overdrafting.

Was it a mistake or neglect possibly? Yes, possibly..but how much punishment for so little crime, if you consider buying a coffee or burger when you were unaware you were overdrafted a crime?

I feel as well..it is very easy for someone not in their shoes to come to this site and throw all the blame on them...and explain to them how irresponsible they are...but if as well...the banks unnecessary policies and tactics were not in place...there would be no complaint lodged..and the hard working tax paying Americans can reward themselves with a 99 cent burger and a cup of coffee after working all day..or..the transaction be declined if the funds are not available and they save all those fees......and this is one of the reasons the policy changes are going to happen..so it may not be the best example for the bank defenders to use all the time.

I guess you just wait around to find anything you can in attempt to discredit me. I guess you don't think I am aware of what you do...or what I type??

If you read the post I left regarding the "short term loan" you will note a few clues of how I was setting you up...

1) I myself would actually consider opting in for courtesy overdraft protection again

2) Now I know this lights up a red light to many

3) in this hypothetical situation

That entire post was only to demonstrate what many people can reasonably assume about OD protection. This is what the banks WANT people to think it is. So when you and others continually call customers "irresponsible" simply because they overdrafted..it is not always the case. And this is what I mean by the bank "encourages" it.

You have read enough of my posts to know I would never even CONSIDER overdraft protection again. I keep a low balance and I do not use checks, so why would I risk having OD protection..I do not wish the bank to allow any thief, shady merchant or scammer have a field say with MY card...the bank allows this to go on without notifying me...the bank allowing unauthorized transactions to go on and on..and then on top of it..the bank charging ME all those fees..and when I lodge a dispute they will tell me "there is nothing we can do"...not this guy. I keep my credit card handy for emergencies...fortunately they haven't raised my rates or canceled it for no reason..yet. 

For many others..the only thing they may depend on in a "emergency"..would be something the BANK themselves so lovingly call.."courtesy overdraft protection"

Which is why I also posted "this lights up a red light" and that "this situation is hypothetical"

What has made me start to believe I may have misjudged you..since I was opening up a little to your side..and trying to understand your views and motives..is that fact that it is clearly apparent you took responding to my post as an opportunity to knock people who are less well off and financially struggling...this is a recession Robert...a bad one...try show a little compassionate please, the banks made enough off the struggling and hardest hit..and enough off the taxpayers...and what do we ask in return???...  just for them to be fair, nothing more, nothing less.

I know in your mind you consider an overdraft as "using the banks money"..well first off do they not have most of ours?..and second of all...do they not get "their" money back and then quite a but more of ours? Or do you take the Kangaroo Courts side that the banks have been losing money from overdrafters?  Go ahead Robert..pick any question to answer so we can debunk it again.

banking sector, and in many other sectors of our economy in the USA, our system would come to a screeching halt. The big banks NEED to generate BIG profits in order to stay afloat, and OVERDRAFT FEES are just one way they're doing it, correct? By eliminating OVERDRAFT charges that are excessive, and border on FRAUD in most cases due to the manipulation of re-sequencing transactions, these banks would most likely COLLAPSE, in my opinion. 


*Our ENTIRE system in the USA has thrived on- FRAUD, DECEPTION, CORRUPTION, MANIPULATION, & TRICKERY for many, many, years. It's all being EXPOSED, and people are realizing what's happening. The BIG banks will continue in their deceptive 'ways' of doing business because that's the only way they can generate the much needed profits right now, and it will eventually put them OUT of business. 

Just watch.

I am a very middle of the road bank employee and let me first address Ronny and his stance on things.  He is very much looking at the situation from a consumer and fairness.  I can appreciate that.  His biggest issues are overdraft protection issues and resequencing.  Overdraft protection needs to be amended.  That is my stance.  For a bank to charge $30 something dollars for ever single transaction that hits is excessive.  Most banks will be capping what they can charge per day.  I am glad to see this change.  No consumer should have to pay back $500 a day in overdraft fees for $1 items.  I agree that is not fair.  Also resequencing falls into this same issue since banks can change the dollar amounts to charge the most fees possible.  Laws are changing and I think for the most part it will help prevent consumers from getting into so many fee they cannot get out of it.

Now to Robert.  Robert is 100% correct when it comes to consumers not taking on responsibility to saving for the future.  I cannot tell you how many times we ask our customers if they would like to take 15 minutes out of their day to speak to a personal banker about future planning for retirement or savings.  All we do is to make sure they are not living outside of their means.  We discuss setting up savings, money markets, and investments to maximize their future retirment earnings.  Now here is the issue....it is totally FREE for them to talk to us, but because they are so busy they wont set up a 15 appt to discuss their options. 

Ronny you mentioned that overdraft should be used for emergencies.  I can tell you that overdraft should never be used period.  Savings should be used for emergencies.  Instead of buying that Starbucks cup of coffee everyday for $5 put that money into your savings acct.  Instead of buying your kid a PS3 buy the child a savings bond or put it into a UTMA account where you dont even have to claim the interest on your taxes.  There are so many things people should do that they are not doing.

But for the record, I like to keep discussions on one thread for easy reference. I'm sure you've noticed by now that many others, myself included, will post the same comments, word-for-word, on different threads. The reason being, sometimes it applies on all of the different threads.

And depending on the issue, some will never see them, if they never see any reason to go view the other thread.

If you post them here, I will certainly disect and show any holes in logic. But if your comments shoot down any of my opinions or judgements, I am always one to give credit where it's due and acknowledge when someone else has a valid point. Even when their point disproves mine, which happens very rarely [tongue in cheek]. :)

Short Term Loan?

Ronny I do have to admit I really do like how you twist things sometimes.  So because someone has a "special" situation they should take the ability to Overdraft as an open invitation for a "short term loan" because they are being "responsible".  You talk about the ethics of the banks, well what about the ethics of using money that is not yours?  It does not matter if you make the deposit in 1 hour or 1 week, the fact is that you have used money that is NOT yours.   What if every one at that bank(or even half) decided to overdraft their account by $100 on a single day.  That bank is going to have some major stability issues, because that money has to come from somewhere.

I was actually wondering when you were going to bring this "car breaks down" scenario again.  How about this as a responsible solution...Plan ahead.  You talk about being able to budget the repair, well what works better than putting a little money aside each week in ADVANCE as part of a budget.  You can then tie that money into overdraft protection where if you happen to overdraft they can just pull it from the savings and no huge OD Fees.  In fact in this case they don't even have to budget for this extra expense because it was covered from the savings.  They may even be a little ahead by getting that lovely 0.25% interest rate.

Oh but what about the people who live "paycheck to paycheck" you ask.  Well yes I would bet if people got serious even they can save $10-$20 a week without a struggle.  Just look at how many reports where people show their debit card purchases.  How many have a majority of purchases at Fast Food or Convenience Stores.  How many times have you heard "If I only knew that $5 cup of coffee was going to cost me $35 I wouldn't have bought it".  So if these same people cut the times they eat out that could save them the $20 a week right there.  If they don't need a $40 cup of coffee, why do they need a $5 cup of coffee?  It just takes people wanting to show financial discipline with their money.  If people showed a little more discipline your scenario would be a non-issue.

I should add...

I myself would actually consider opting in for courtesy overdraft protection again once the banks can no longer re-sequence transactions...because I will then be the one truly in control of my money..not the bank.

Lets say I am running low on funds..and my car broke down. If I needed some funds beyond what is available in my account to get my car fixed so I can get to work..and I know my direct deposit is going straight to the bank anyway..whether I want it to or not..then the protection can actually be used "responsibly" as a short term loan. Now I know this lights up a red light to many..but since I would be making a deposit quickly to cover the overdraft...the "interest" rate so to speak, would still be in the very high..win for the bank..right?

Win for me too..since my car will be fixed...and since I can rest confident that the bank would not be manipulating anything...I can still budget the fee into my financial statement or register..and all will be well. So in this case..the evil overdrafter was actually "protected"...the bank actually provided a "courtesy"..the bank collected the agreed to fee as per THEIR TERMS for providing said "courtesy service"..and not a PENNY more from manipulations. So in effect..the evil horrible overdrafter (me) actually overdrafted with responsibility in this hypothetical situation...am I wrong here?

...It only proves more so that you and the others who do this... are bank defenders, first class. And regardless of you posting B of A's terms ...it still seems B of A has a larger percentage of the complaints posted on ROR as compared to many others...so, what does this tell us?...and what good has it done?


And..you also need to take into consideration what is happening with bank takeovers and mergers..customers terms have been changing without them being aware or agreeing to it.


And the bank defenders who keep using the term "vast majority" need to realize it does not matter. As even if only one customer was subjected to any additional fees brought on by an unnecessary policy (or a tactic if you want to be honest about it)..then it needs to be addressed. If any business is pilfering and scamming people...they are just as guilty if they did it to one person..or millions of people as the banks have..it is irrelevant to us mentioning the percentage of customers who fell for or got caught in the trap...it will be and IS being addressed..and not just by Edward and I apparently.


As far as the consistent statements by bank defenders regarding that "it doesn't matter how banks process transactions"..as mentioned many many times here...it does matter... if you overdraft. Now to think no one will ever overdraft just because the percentage of customers who do overdraft is less then the ones who haven't..still leads to the same question..that does not seem to EVER be addressed or answered here..and that is why did the banks find it necessary to re-sequence ANY transactions anymore?..if have Edward and I have pointed out..is no longer necessary..for ANY reason the banks have given...so do you or any other banks defenders know another reason that the banks won't tell us? Why have Edward and I (and even Karl) been able to figure this out?


I don't "enjoy" calling anyone a bank defender..but I call it as I see it. If this whole issue was as simple as "reading legal documents"..then why the pressure from congress? Why all the lawsuits?? Why all the complaints? why 38 billion dollars in fees this year? and why are the banks themselves starting to change these horrible anti-customer policies as we type here?




I will now address your last statement...by section...



"I know that you believe the new policies will change everything but consider this - do you really believe that the banks won't come up with some kind of new strategy to deal with people who are chronic overdrafters?"

This is too easy to clear up. First off..lets get this out of the way. A so called "chronic overdrafter" is not a criminal. And not a bad thing for the banks..right? Otherwise why does the bank not close their accounts?

Now with that said...after the changes are put into effect..and a customer decides by their own choice..to sign up for courtesy overdraft protection..and then chronically overdrafts..they will get fees for the overdrafts. Now...for the banks that will be no longer re-sequencing transactions..which I believe will eventually be ALL of them..then the chronic overdrafters..and ANY overdrafter who CHOSE to enroll in OD protection..can not lodge a legitimate complaint ever again..period..end of story. Does this mean some of them won't lodge complaints? Most likely not..but I won't be able to defend them..no one will.


" Perhaps a fee for denying transactions like they used to do with checks or even closing accounts for people who habitually attempt to go beyond their available balance. Trust me, even with the changes people will still have to adopt sound financial management techniques."

There would be no point to doing this. If the banks decide to charge a fee for denying transactions..then they better make d**n well sure those online statements are not manipulated..otherwise it will be dealt with as well. However..if they did charge a fee for declining a transaction..at least the customer won't be subject to all those additional fees caused by manipulations..AND if they have half a brain..will know to figure out that the account is empty..or they need to investigate why it was declined...this is giving the customer a fair chance..which is all the can be expected.

If the banks chose to close an account for someone who continually attempts to overdraft..so be it. If the customer is aware of this policy..and is not charged OD fees for transactions that cleared..then that is up to the bank.

As far as people adopting "sound financial management techniques"...I have no rebut to that..I agree with it. Now lets just hope the banks themselves can learn to do the same, and not BLAME everyone else for their mismanagement, so we don't have to bail them out.... AGAIN.

Federal Reserve chart, shown at the site which can be 'Googled', entitled- WHO OWNS THE FED?, lists the following members: JP Morgan, Morgan Stanley, & Lehman Brothers, then it would be safe to assume that the Federal Reserve has $11 BILLION in 'secret life insurance policies' on some of the lives of their current & former employees at JP Morgan Chase branches in the USA, right? I'm sure you 'Googled' this- BANK EXECUTIVES PROFITING ON THE DEATH OF EMPLOYEES, and read that article, correct? It states in that article that Chase has $11 BILLION in policies, doesn't it? And I'm certain you 'Googled' this- JP MORGAN CHASE COMPLAINTS SECRET LIFE INSURANCE POLICIES, and read that article too, correct?


And if you 'Googled' this- DID SPECULATION FUEL OIL PRICE SWINGS, you would have been able to see that Morgan Stanley was named in that '60 Minutes' segment about the 'speculation' of OIL last year when the price went well over $100 a barrel, & even up to $147 a barrel, right? I'll never forget paying $4.49 a gallon for premium unleaded last year. OUCH! And if you 'Googled' this- INSIDE THE MELTDOWN, & watched it on the web, I'm sure you saw where Lehman Brothers COLLAPSED last year, correct?

QUESTION: Do you believe that the Federal Reserve is GOOD for America, & the American people?

Time Running Out on Lawsuits

For those class action lawsuits filed within the last few years and still pending, I would say their chances of winning are, uh, 100%. One of two things will happen. You will start to see a flood of settlements initiated by the banks, or the banks will lose on day one if it makes it all the way to court. Plaintiff lawyers would only call one witness, the CEO of the bank. And they would only ask one question: ''If you say this lawsuit is baseless and without merit, and your policies are not unfair, why are you now in a rush to abolish these same policies? No further questions and the people rest.''

Now to the re-sequencing discussion and a very familiar quote often used by bank defenders and consumer critics. The quote from Edgeman: ''However, the vast majority of people with checking accounts do not overdraft their accounts...''

Remember that survey several years ago, when the banks 'lied' to us? They told us their customers indicated they would prefer the largest items paid first because those are the important items like mortgages and auto loans. If 99% of customers have no problems at all would overdrafts, like they claim, re-sequencing is not an issue for them, so why would they care? For the 1% of customers who do have overdraft problems, re-sequencing only worsens things for them, so why in the world would they be for it?

So we have ourselves a hypocritical dilemma. Out of one side of their mouths, the customer critics and bank defenders, like Karen, say they are part of the 99% of customers who know how to keep and balance a check register, and they consistently chastise and insult other customers. But out of the other side of their mouths, this same group supports and PREFERS re-sequencing because they would rather have their mortgage check paid instead of the McDonald's Big Mac. Again, why would that matter if you're a part of the 99% of customers without overdraft problems?

The obvious hypocritical contradiction is the ripoff here.

If you dig around RipOff report, you'll find that I have agreed that resequencing transactions from highest to lowest works in the banks favor if the account holder overdrafts. However, the vast majority of people with checking accounts do not overdraft their accounts and Karen's point is valid. Always stay within your available balance and it doesn't matter how banks process transactions. It shouldn't even be an issue.

Now I know that you enjoy calling us "bank defenders" but if you really think about it, we are the ones who have been advocating paying the banks less (or preferably nothing) in overdraft fees. I have also been trying to drive home the point that people really need to read and understand legal documents before they sign them.

When Bank of America has this in their account agreement-

"We may determine in our discretion the order of processing and posting deposits, fees, charges, checks, debits and other items o your account. We may credit, accept, pay, certify or return deposits, fees, charges, checks, debits and other items and other items arriving to your account on the same day in any order at our option. We may give preference to any fees, charges, checks, debits or other items payable to us. We may change our processing and posting orders at any time without notice to you.

     We may establish categories for fees, charges, checks, debits, and other items and designate a posting priority for each category. A category may include more than one type of item. For example, we may treat ATM withdrawals and loan payments as one category and checks as another category and then process ATM withdrawals and loan payments before checks. Within each category, we may process and post items in any order we choose. We may use the same or different orders for different categories. We may change categories and order within categories at any time without notice.

     When you do not have enough available funds in your account to cover all of the items presented that day, some posting orders may result in more insufficient funds items and more fees than other orders. We may choose our processing and psoting orders regardless of whether additional fees may result. If you want to avoid fees for insufficient funds and the possibility of returned items, you should ensure that your account contains sufficient funds for all of your transactions".

and:

     "We do not process transactions in the order in which they occured". and: "In most states we process and post items within each category from highest to lowest dollar amount. If you do not have enough available funds to cover all of your transactions on any given day, the high-to-low posting order may result in more insufficient funds items and more fees than may have resulted if we had used another posting order."

We have a situation where the customer authorized the bank to process transactions in any order and knew that the order was likely to be from highest-to-lowest. If they know that and have a series of pending transactions and still choose to use careless financial management, then this is a situation of their own making. Financial suicide, if you will.

I know that you believe the new policies will change everything but consider this - do you really believe that the banks won't come up with some kind of new strategy to deal with people who are chronic overdrafters? Perhaps a fee for denying transactions like they used to do with checks or even closing accounts for people who habitually attempt to go beyond their available balance. Trust me, even with the changes people will still have to adopt sound financial management techniques.

Not quite the end of story..yet. Once the changes go into effect...possibly.

Because if you yourself personally have not fallen into the trap of re-sequencing combined with mandatory forced "automatic" overdraft protection..you have no place in this discussion..

Because...it goes without saying that "if you have money in the account to cover all transactions..you won't overdraft"...but answer this...why does the bank need to re-sequence any transactions at all then?

If the customer has overdraft protection...but never overdrafts...what is the point to re-sequencing?

If the customer is not forced to "automatically" opt in..then they will not have OD protection..so what is the point to re-sequencing?

If the customer has overdraft protection..and does overdraft..the bank covers ALL of the transactions..coffee, diapers for the baby, condoms..AND the Mortgage...so again..what is the point to re-sequencing?

Seems to me since judging by most of the complaints..that the only purpose..and the only RESULT of re-sequencing..has been for the bank to charge overdraft fees for transactions that actually has the funds available at the time of the transactions..otherwise ,it would have been IMPOSSIBLE for the bank to charge an overdraft fee for it.

Now if you think people should pay additional fees above and beyond any legitimate overdrafts as some kind of "punishment" for not taking "personal responsibility"..then you are worse then the banks..who at least attempt to sugar coat their tactics by putting the word "courtesy" in front of said tactic.

Now with that said...yes..many overdrafts are caused by carelessness..error..perhaps someone is a little "slow" to catch on..but have they committed a crime? No..since the bank offers a service..which has discussed previously is called "automatic courtesy overdraft protection" So it can't in all reasoning be a crime to overdraft..since the bank permits it or even forces it on us in some cases..and charges a fee for the service provided..and covers the overdraft. In this case if it was a crime..the bank would technically be an accessory.

So..is overdrafting a crime?  NO

Is an overdraft caused by being irresponsible a crime?  NO

Is the bank charging ANY overdraft fees...for ANY customer, who overdrafted for ANY reason..to be charged any ADDITIONAL overdraft fees for any transactions that had the funds..but SOLELY due to the banks manipulations..were charged fees? Many feel this is a crime..or at the very least..a swindle..a trap...and pilfering, to be nice and only name a few.

So...the banks must agree as well..since they ARE currently changing policies to allow the customers to choose how they best wish to "protect" THEIR money..and protect themselves from excessive fees..brought on by forced OD protection..and as proven ..the completely unnecessary re-sequencing of their transactions.

I think even a sociopath could understand this..am I wrong?

average lifespan may be longer now than in the 1930's. However, if you or anyone else believes that 'living longer' is a benefit, consider this- many people ARE 'living longer' today, but they're doing it in Nursing Homes, and most are on multiple prescription drugs which don't make a person's 'life' any better, correct? If a person who lived to be 65 years of age in 1930 did it without being put on prescription medication and being placed into a Nursing Home, and had a 'Happy Life', & died at age 65, then what's wrong with that? We're all going to die someday, correct?



Now if that same person in 1930 could be put into present day and needed to be put on DRUGS sustain their life for another 5, 10, or even 15 years, does that mean that the person's 'life' was really better than before? My "Better Half" is an ICU Nurse. She sees elderly people come into the ICU all the time. Many of them are 'living', but they're NOT really 'living life' as they once were. Putting people on DRUGS, or placing them into hospitals to have their lives extended doesn't necessarily mean that their lives are any better. In most cases, they're WORSE! 'Lingering' for an extended period to ensure one's life is 'extended' isn't my idea of a longer, happier life.



*ONE MORE THING: Go visit a Nursing Home in your town. Walk through it and pay close attention to all the people who are 'living' there. Is that how YOU want to spend the remaining days of your 'life'?

I am one of those. I was cut to part time, even though the company I work for is posting gains in revenue this quarter despite the recession..and I have lost ALL of my benefits..even though there is a slot open for full time..and I am available full time hours, and MORE then qualified for the position. But fortunately..since this is AMERICA, and there still is opportunity for those with motivation, innovation..skills, and a little luck..there is possibility to ride this out..I am using a home based Ebay business to supplement the loss of my benefits and cut hours.

I was a census worker several years ago while still in college. We were instructed to count everyone..regardless of citizenship status..since we are not required to ask citizenship..nor was anyone required to "volunteer" this information to the census bureau. Not that this negates what you posted..which may in fact be accurate..but I can tell you first hand..illegals are being counted as "citizens"...houses PACKED with them, by the score.

According to my great grandmother..whom I helped edit her autobiography before her death...there was also no food in the 1930"s..or at least not like it is today. The average American probably throws away more food PER MEAL...then the average "provider" during the great depression had to feed a family for a day.

I do not believe I have heard any claims by anyone posting here..be it bank defenders...posters of complaints..or the sociopaths ever argue that we are in recovery. Because regardless of whatever any "economists" say..we have discovered as evident by history..that they are more often then not..WRONG..but as well..anyone with half a brain should see the signs that we have not bottomed out yet. But I believe we will...and then recover. How long it takes is anyone's guess..but it may be years. I am fortunate I work in the technologies industry...as Americans and the rest of the world have become as dependent on that..as they have food and a home..so I feel pretty stable for now..even thought I was cut hours and cut benefits. They gave me almost 38 hours next week...imagine that?

Yes..there are infinite "scenarios" we all can come up with that can cause an overdraft...some legitimate..some debatable...

But to me it is much simply viewed.

IF..and I repeat..IF the bank allowed a swipe at a gas pump when the balance was low..and it overdrafted the account....which I guess in all the infinite possibilities...is possible to occur...then the overdraft fee if so applied..is legitimate.

But....at least the customer can rest assured...that for what ever reason the account was overdrafted..be it negligence..mistake, fraud, theft or unauthorized use of debit card, intention, stupidity..drug addition, slack jawed wife beater tee shirt wearing meth lab owner, customer of "I am the Laws" bank branch...it won't matter ..or cause any other then the fee for that particular overdradft.

Because WHEN re-sequencing is no longer a trap/threat...the customer may be subjected to a fee..a SINGLE fee..for the SINGLE overdraft at the gas pump...but once that account has posted overdrafted..no other transactions after that point will be allowed to complete or process. Hence not only will they not be subject to any more "legitimate" overdraft fees because it will be impossible..but since re-sequencing will be a thing of the past..not a single bank manipulation will be possible to apply fees to any transactions that had the funds "available" as posted..for the purpose of causing overdraft fees...so hence..NO LEGITIMATE rip off report could be lodged....it would be too easy to discredit and debunk it..just like it is currently too easy to discredit and debunk many of the bank defenders defenses we read here...kind of like "opposite/ignorant world"... where most bank defenders currently seem to reside.

As I have stated a zillion times here...it is very easy for someone who has not been in the situation..or been "trapped" into the scam..to simply state "it's all your fault, the bank did nothing wrong..the bank didn't force you to overdraft..take personal responsibility...if you don't overdraft it doesn't matter if the bank SCREWS with and un-necessarily manipulates your sequence of transactions, learn to use a register..balance your account...use cash.. etc etc etc same thing that has proven useless over and over relentlessly,,and redundantly.. on these reports...."

..but none of the feeble, canned, generic, compassion-less sociopath bank defenders statements mean anything..if a SINGLE customer, yes...ONE SINGLE CUSTOMER was EVER charged ANY fee for overdrafting...that was due to a manipulation of the time/order of the transaction by the bank. ANY overdraft fee that was applied to any transaction that had the funds available at the time of the transaction is nothing less then annexation, appropriation, , burglary, caper, cheating, CON, crime, defrauding, deprivation, embezzlement, extortion, filch, fleece, fraud, heist, , hustle, larceny,looting, mugging, peculation, pilferage, piracy, plunder, purloining, racket, rapacity, rip-off, robbery, SCAM, steal, swindle, and ... a "trap".

Robert I am afraid you are quite mistaken there buddy.  I can tell you since I have managed quite  afew banks that in fact it does affect your available balance.  If a customer has $20 in their account and they go to the gas station and pay at the pump normally the merchant places a hold of some type normally $1-$75 against their available balance.  So if the customer went out and bought $15 in gas but the merchant held the $75 the customers account would be -$55 and anything else that posted against it would incur an overdraft fee even if they had the money in their account.  Now I can tell you I do not agree with this policy mainly because a customer who kept a good record would have no idea where the fees would be coming from.  But to rebut your last statement yes gas pumps, bars, hotels and rental places DO affect your available balance.

Falsehoolds About Gas Pump Holds

Ronny G, you found a way to sum up all of these infinite exceptions the bank defenders often throw out:

''I have not read too many complaints here that a customer who was opted out of OD protection was allowed to pump more gas then they had available in their balance..but if this is the worst of the complaints we see here after the changes are put into effect..I think we can live with it''.

Most of the recent fallout against all of these fees is when many banks began the new practice of charging fees for holds. Most banks refer to it as the Unavailable Funds Fee. While a transaction is sitting there ON HOLD, PENDING and UNPOSTED, the bank charges fees for all of the other ten or twenty transactions that post while the 'Available' balance is negative, because of the single, PENDING transaction. The reason the gas pump hold is a non-issue is because gas pump holds NEVER show up as pending transactions. Is that clear enough to end this often used fallacy?

If your Available Balance is $50, and you swipe your card at Walmart for $75 that leaves your Available Balance negative ($25). If you have five small transactions that post while the Walmart transaction is PENDING, all five will be charged a fee, even though your real Posted Account Balance was sufficient to cover all of them.

If you substitute a gas pump transaction for the Walmart transaction in the example above, none of the posting transactions will be charged a fee while the gas pump transaction is on hold because it doesn't show up as PENDING and doesn't affect the Available Balance. Is that clear enough to end this often used fallacy?

STAY AFLOAT! Keep watching the price of OIL over the next several months and into 2010 & 2011. Our 'leaders' are now realizing that the worst is NOT behind us, in my opinion. There were over 900,000 foreclosures in July- September. It was the worst 3 months ever! 'Google' this- FORECLOSURES: WORST THREE MONTHS EVER, and read it.



Job losses continue at alarming rates too. We'll soon go over 10% unemployment, and the 'real' unemployment rate is around 18% because many people have given-up, and others are 'under-employed' (working part-time jobs, but want full-time work.)



This country of ours has turned into a BIG joke, wouldn't you agree? The banks need to manipulate overdrafts in order to make profits, right? You see, our system thrives on- TRICKERY, MANIPULATION, & DECEPTION, correct? Without those elements, our economy can't function, right?

Reconcile I shall Robert...

The funny thing is Robert...I am a fairly good judge of charactor..not 100% of the time..but I bet we have similar views on many things,,I just get that feeling.


That aside..I refuse to keep typing the same things over and over. There are enough replies by me left on this site to CLEARLY make it apparent waht I feel the banks are doing wrong...and I also CLEARLY explain the customers part in this as well.


BOTH are doing wrong..and BOTH need to make changes..or we will continue to see these report over and over...


And now to your question...

Again you with the freaking gas pump. I will state this again very CLEARLY..and this applies to gas pumps or any pump...IF the overdraft is LEGITIMATE...there will be a fee. IF the customer complains about a LEGITIMATE fee..I will be there with you defending the bank. Because if this is what it all has to come down to in our debate... you want to narrow this whole issue down to a gas pump so be it....if the customer is using their debit card as a credit card..they need to be aware that it will be possible to overdraft..or as they call it with a credit card..going "over limit".

I have not read too many complaints here that a customer who was opted out of OD protection was allowed to pump more gas then they had available in their balance..but if this is the worst of the complaints we see here after the changes are put into effect..I think we can live with it. Now I do not know if all banks do this..but once I opted out of OD protection with my bank..I noticed if my balance is below a certain amount..if I swipe the card at the pump...it tells me "the transaction can not be completed..please see associate inside". So perhaps the banks already thought about this? I don't know but either way to me it is a non issue and involves no under-handedness on the banks part..hence no legitimate rip off could be lodged.

Please reconcile this..

You agree that many customers are repeat offenders.  You agree that some are doing it with INTENT because of what they THINK will happen.  You agree that many hold responsibility for overdrafting.  You don't have much pitty for ones that continue to overdraft once they realize how banking works.  But then you twist to where they become the victim

and especially those who did not want a transaction to clear if the account was below zero

If the account holder didn't want a transaction to clear if they were below zero.  Wouldn't logic dictate that they probably should make sure that their balance is not below zero when they made the transaction.  Oh and that also takes care of the posting order because if they don't go below zero that no longer matters as well.

Again I am not saying that they should not have a right to opt-out of the overdraft protection.  But really why is is so hard for you to come right out and admit if the account holder actually managed their account this would not even be needed.  After all you have admited just about everything else where it is actually the account holder who needs to be held be responsible.   I really am curious in a few months as to what side you will take when an account holder opts-out.  They then get hit with a $35 overdraft fee, because they pumped $40 in gas with $5 in the account, since they "thought" that it should have been stopped.

 I do recall you usually seem to be fair and unbiased in your responses.

Yes it is called rip off report for a reason..so lets post the definition of ripoff from the online encyclopedia...

A ripoff (or rip-off) is a bad deal. Usually it refers to an incident in which a person pays too much for something. A ripoff is distinguished from a scam in that a scam involves wrongdoing such as fraud; a ripoff, on the other hand, is in the eye of the beholder.

In the eye of the beholder is key..because (and I am not talking about you here) the majority of the bank defenders are almost sociopathic in their inablilty to understand or reason with the fact...that the customer often has a legitimate reason to FEEL as though they were ripped off..whereas the "eye of the bank defender" fails to see any but the banks side, every time, regardless of circumstance.

Many of us feel the banks are using tactics that are VERY unfair..so if a customer wants to be involved with a class action lawsuit against the bank they FEEL wronged them..what is so unfair?

Getting involved with the lawsuits (and there are PLENTY to choose from) will not cost them a penny..just a little time. The law firms simply want to ask some questions..and document some evidence. What did cost the customers money that they feel was unjustly stolen from them..and quite "unfairly" I might add..is when the mandatory forced un-requested courtesy overdraft protection service was combined with the unnecessary un-requested re-sequencing of transactions.

Now exemployee..you tell me often you are still a bank employee..and I don't believe you told me for which bank..and may not be allowed to...but perhaps your bank does not practice deception and manipulation for the SOLE purpose of maximizing fees....but to wit from many of these reports...we see this occur.

While I do agree with you many customers are repeat offenders..I do believe some even though overdrafting with intent..truly believe they are only going to receive fees for the legitimate overdrafts "per"..and pay the fee as agreed to by the terms of their bank. Of course they are angry when it turns out that due to time manipulation..they are being charged with far more fees then then expected..or deserved.

This is not to say the customer holds no responsibility for incurring an overdraft..as many do..and I don't feel too much pity for any customer that understands how the bank works..and continues to overdraft with no regard.

But for ANYONE who was victimized (yes I used that term to describe it..sorry) by manipulations and re-sequencing...and especially those who did not want a transaction to clear if the account was below zero..but it did anyway..I hold the banks just as..if not more so responsible.

I hope you see our side...you have been very reasonable for the most part..I do not think you intend malice on your customers.

I hate with a passion that any of this has come to lawsuits..and further legislation..but if the banks can not on their own come up with a business plan that allows them to survive and profit without resorting to questionable tactics and unfair and unethical treatment of their customers..then I say let em close up shop, or do the right thing.

interesting how much control the banks & the bankers have in America & all over the world, wouldn't you agree? Banks can do almost anything to their customers, & even

to their employees, right? I'm sure yo 'Googled' this- BANK EXECUTIVES PROFITING ON THE DEATH OF EMPLOYEES, and read that article, right? Just the 3 banks named in that article have $45 BILLION in 'secret life insurance policies' on their employees, correct?

And a Texas law firm is representing some of those bank employees, right? Anyone can 'Google' this- BANK OF AMERICA COMPLAINTS SECRET LIFE INSURANCE POLICIES, and read all about it! The banks certainly seem to have a 'stranglehold' on Americans, huh? And our wonderful government handed them $125 BILLION in just one day, right? I'm sure you 'Googled' this- INSIDE THE MELTDOWN, and watched it on the web, huh?

And just think, the Federal Reserve will make interest on the money it loans the U.S. government to fight the WARS over in the Middle East, right? I think when I come back someday I'll be a banker. I'll lend money to PEOPLE who can use it to make the WORLD a better place.

This website is called rip off report for a reason.  It is because individuals come on here and complain against companies.  The vast majority of people have never had more than a couple of overdrafts and they understand why they get them.  If you think banks are ripping you off imagine the amount of money it is going to cost you to hire an attorney or the time lost from your job to talk to attorneys about OD fees.  You can take a bank to court for allowing a abank to rip you off I agree that is your choice, but take it from me all banks have the verbage about how overdrafts occurr and resequencing transactions and most banks will even try to explain to you how to avoid them in the future.  I can guaranty you most of the individuals who come on here and complain mainly because I have dealt with them in the past are repeat overdrawers of their account.  It is about balancing a check book, utitilizing online banking on a consistent basis and not living outside of their means.  Banks are financial institutions that are their to lend money and keep your money safe.  It is the CUSTOMERS choice to use a debit card or withdraw their money.  Banks do not force customers to do these things.

Just take a few hours and google "wachovia lawsuits"  then add words in the search like "re-sequencing" "re-ordering" "courtesy overdraft protection" etc.

Also you can contact Finkelstein Thompson LLP, the information is on their website..I am sure they would love to speak with you. They are one of the many lawfirms looking into this.

Now a few nimrods will come here to insult and blame you. However they are not the ones who feel they were ripped off by this bank..so just blank them out..non issues.

Only you know if you were ripped off. The banks have already started to change some of these tactics and policies voluntarily..since all the complaints, pressure from congress and pending lawsuits is backing them into a wall.

Until then..now that you are fully aware of the tactics..arbitrary excessive check clearing and holding times..and the fact that polices are changing ..or seem to be without your knowledge or consent...be so careful to protect your money like you never have..make it your 2nd job..when you get up in the morning..and before you go to sleep..do not let these thieves bilk one more penny from you..because they consider covering an overdraft as a "courtesy"..regardless of how much it costs YOU.

So tell me, why did you use your debit card 3 times when you knew you didnt have the money in your account?.  Who cares if the holds are not posted for 7 days.  The vendor took his time submitting the charges to your bank.  That is his business.  your business is to know what you have withdrawn from your account.

YOU MUST RECONCILE THE AVAILABLE BALANCE FROM YOUR REGISITER WITH THE AVAILABLE BALANCE FROM THE ONLINE BANKING SYSTEM.

IF YOU DONT KNOW HOW TO DO THIS, GO BACK AND ASK MOMMIE AND DADDY TO SHOW YOU.
