I went to mediation with her and she still refused to pay.

Wendy Schnitzer, now Wendy Lynne, is a culinary nutritionist who wants to go national. Although she has the talent, her business practices of negotiating a discount up front, then requiring more work after the contract is signed, then asking for a refund after tons of work has been done will surely hinder her success. While prepping for mediation, I found I was not the only provider this scenario has happened to.

The membership program she signed up for is one year with set amounts of work to be done each quarter.

She front loaded all the consulting to the first quarter of the membership program rather than spread it out over one year, got extra hours of consulting on top of the contracted amount FOR FREE, and then asked for a refund after 3 months. She was told of the refund policy of having to fully participate for 6 months and given the option to remain in the program. She stated she needed the refund to pay people to implement the plan I had created for her!

The Satisfaction Guarantee states: "Provider guarantees that Client will be satisfied with the Program after six (6) months of participation in good standing or Client will be reimbursed 50% of their membership fees."

Also this requirement in the contract: "After ten (10) business days of registering, Client cannot cancel payment into the program and is obligated to pay the entire twelve (12) months of the Program."

The contract speaks for itself. She has easy access to the top lawyers in Seattle for advice. She read and signed the contract. During mediation she was read and explained the contract and told that she was not due any refund. Even though she admits she signed it, and admits she understood it, she thought I should still give her a refund.
