Our mortgage has been serviced by four different companies in about six years. I've never had the first problem until Bank of America. About 18 months ago they began threatening me with foreclosure and said I was behind on my escrow.
The original payments were in excess of $500. They got up to $966.77, including escrow (which has always been included in payments), $39.34 FHA MIP , $116.01 late charges and $15.00 fees due. They finally admitted two months ago, with help from my insurance company, that my payments should be $836.64!! Wow! I continued to send the $966.77 in hopes they would apply difference to amount they claimed I was late but they refused it and mailed me a check for the difference.
I have tried the 800#, only one I have, numerous times attempting to get assistance - all in vain. I wrote two letters asking for a loan modification and received two from them telling me the paper work was being handled to modify the loan. I've not received anything to that affect and almost every day I get letters threatening foreclosure because I'm in default. That amount has risen to $1,924.65 from $800. due to the addition of late charges and fees every month.
My husband is disabled and has been bedridden for years. I'm worn out fighting with BofA!! The interest rate has remained at 6.5%, my escrow has decreased yet my payments have nearly doubled. I owe about $70,000. less than the last appraised value. I'm being RIPPED OFF!

Dear Linda,
We routinely look for posts to answer in hopes that it will not only bring optimism to those homeowners and borrowers in distress but also some basic information to assist in fighting the banks that are "too big to fail" but yet don't appreciate the bailout that we provided in their time of need. The debt collectors like SPS, SLS, Green Tree, Ocwen and Nationstar are simply just piranhas but they can be beat at their own game too just like the big banks can be defeated. You CAN win this fight!!!
It pains me that you have fallen victim to the illegal, unfair, deceptive and abusive acts and practices of Bank of America, but I also commend you for seeking help; too often homeowners do not fight for their consumer and constitutional rights. Bank of America has already admitted wrongdoing this year and agreed to the largest settlement in banking history in the amount of $7 Billion this year as a result of the admitted wrongdoing. This is an excellent time to assert your consumer and Constitutional rights!
With that said, you have overlooked a key aspect to your fight, which is putting your valid objections and escrow issues in writing in the form of a proper QWR and attaching proof your consumer and Constitutional rights; they have certainly been violated in this case as I see it. All of the mortgage lending and debt collection companies, including Bank of America, MUST answer your Qualified Written Requests (QWR) and if they refuse to then you take your fight to all the regulatory agencies outside of Bank of America that assist in fighting for your rights like the CFPB; it’s a shame that these more than profitable and previously bailed-out companies engage in this type of consumer abuse.

Feel free to 'Google' this- ALABAMA ATTORNEY GENERAL, and send him a copy of your Ripoff Report immediately. All of the information is available on the web.
It appears that the bankers, and others, are specifically targeting people who have equity in their homes. It's a quick way for the banks and their investors to make money. You can also 'Google' this- INDYMAC BOYS GET SWEETHEART DEAL, and watch that video on the web in order to see that the bankers are also making money on homes that do not have equity.
To sum it all up in a nutshell, the bankers are ultimately in control of the U.S. government and Wall Street. They are going after as many homeowners as possible in order to generate profits in order to keep their investors from losing money. Some of these 'investors' include governments from other parts of the world who were foolish enough to invest in the BIG Ponzi scheme that was orchestrated by the Wall Street bankers, also known as the 'housing boom' in America which eventually went 'bust'.
