I read several postings, especially John who was seeking a class action. I am seeking anything. My house is gone. Foreclosed for $300. That's right $300. It was horrible they didn't apply payments, overcharged escrow, changed my insurance carrier, had to file bankruptcy and they still foreclosed on the same house for the third time. I have had two senators involved and it is currently before the treasury department. They told me they never put phone conversations in writing, they don't meet with people in person, they demand resolutions in hours.
I was airborned a package that I received at 2:00 only to be told to have it signed and back with a check at 5:00 or else. I was told to drive one package to a lawyer 4 hours away. Problem was I only had two hours. They conceded that was impossible so they told be to Western Union the payment to their office in the Midwest by 8 the next morning. Only problem was I wouldn't have the money till that evening when a client was to pay. I had already told them that and they insisted. I told them the banks don't even open till 9:00.
It all started when we were hit with a flood and I asked for help through the next three months. I wasn't behind, even paid ahead a bit. They told me they would put me on a moratorium for three months then start to make payments on the fourth month and they would tack on the extra payments to the end of the loan. Guess what I had one month off, the second month they sent a foreclosure notice. I told them of the error and they said.. oh we stopped that program. I was forced to modify my loan with much larger payment. I sent the first check, I sent the second check and three weeks later it was returned to me by Wells Fargo saying I was supposed to be paying an additional $300 a month. I said I paid the invoice as I was told, already $300 more than my original payment. I told them I would send the the $300 and they refused. They said once I was put on the moratorium they could foreclose at will. I played the same CSR games as others here, was even told at one point that it is company policy for people not to get the same person twice so as not to create a relationship. Oh by the way I was evicted without notice.
I had actually thought we had things almost cleared up last August when I arrived home from taking my kids to school and the police were there. I was devastated. In the five year period of time we have been fighting with them I asked for face to face meetings, they declined. I asked to put their offers in writing when they asked me to send good faith funds. They declined. After sending my phone number on each correspondence they said they could not reach me. I told them I never received voice mails on any phones. They said they called the number on the file. I asked why didn't they call the numbers I had given through faxes and e-mails as the number of the files was never one I had had. They said I didn't call them. I did fax and have plenty of records. They just responded to my complaint to the treasury department. Guess what they falsified documents. Letters don't match their own spreadsheet. It shows my payments being made during the same time period in the letter that they said I wasn't making payments.
I want to know others who have experienced the same. Also tips from others who might have succeeded. I had almost paid our house off, they got the equity the house and a good chunk of my belongings I couldn't get out in time. They didn't send notification by sheriff or certified mail. So, funny seems they had no trouble overnighting documents to me before.
