Put in 1st mod application to GMAC 6/23/10 (ARM Loan).  Pmts were auto-deduct from my checking & I was current until after they recv'd my app & paid my real estate taxes (not escrowed), then cancelled my auto-deduct because I was then in arrears. Tried to get them to reinstate auto-deduct & make arrangements to pay back taxes they paid, but they said not necessary...arrears would be included in the mod package (which was still in review & not even approved yet!).  They put me on a 3-month trial payment plan, all of which I paid.  I was denied under the HAMP Program, but approved for an in-house mod. On 10/13/10 @ 12:04 P.M., was hand delivered a mod agrmt. by Fed Ex.  Cover letter from GMAC required the signed documents & 1st pmt due back in their office by 10/15/10!  I called them to request add'l time to have paperwork reviewed by someone.  The person with whom I spoke assured as long as I got signed docs & payment to their office within the 15-day grace period (11/15/10), I would be okay. On 11/4/10, I received call from GMAC that my mod was denied as I did not get the docs to them in time. Tho I explained the above, didn't matter, but I overnighted signed docs & pmt to them anyway, which they rec'd 11/5/10.  Then rec'd a formal denial letter, along with their stmt (in writing & by phone) that my check would not be cashed & mailed back to me on 11/8/10.  On 11/18/10, I faxed a 2nd mod app & tho all info was same as 1st, I rec'd denial letter dated 12/29/10 that I had "sufficient" income. Phoned GMAC  & was told that was a mistake...denial letter should have read I had "insufficient" income. She found that GMAC made mistake calculating my expenses...they "doubled" the monthly amount for real estate taxes, homeowners insurance & added a credit card pmt which did not exist. Tho the person with whom I spoke assured she would submit a work order re: their error, low on trust, I req'd she send me another app.  On 1/18/11, I was hand-delivered a foreclosure notice with a sale date of 5/18/11.  My HUD Counselor approved me for a 90-day foreclosure deferment (Colorado Law) & I faxed the 3rd mod app to them on 1/26/11, again to be denied by letter dated 2/18/11 due to "insufficient" income. I  made all 3 pmts required under the deferment, extending sale date to 8/17/11, but both GMAC & their Denver attorneys never updated the sale date until recently, but to 7/6/11.  Where they came up with that date, I have no clue, as each payment I made under deferment added 30 days to sale date.  I've filed a "4th" mod app.  Also, found they cashed the check they said was sent back when I looked @ my bank statement but didn't let me know.  Way more to this story...this just small portion!! We bailed them out & this what we get in return?? Has anyone had any luck in getting help on this...legal or otherwise?  FYI:  I am on the Fed & State Do Not Call List for solicitation/marketing, will not answer an unknown call & will file a complaint if I'm contacted by a company soliciting debt/credit/foreclosure help.  I do welcome assistance from a lawyer or government office.

Karl, thank you for all of the information & suggestions you provided.  I began working with Senator Udall's Office regarding this matter and as you suggested,  they said they would get my letter to President Obama.  They are acting as a liasion between myself & GMAC, working directly with the Executive Offices of GMAC.  This keeps me from having to speak to so many different persons with so many different, contradictive statements.  As a retired paralegal, a light bulb went off recently.  Why it didn't come to me long ago is beyond me, but when GMAC went ahead and cashed the check I wrote for the 1st payment on the modification that they subsequently denied because they stated I didn't return it in time, they essentially agreed to the modification.  They never refunded that money to me.  They actually cashed it the old-fashioned way and not electronically, so I have since gotten a copy of both the front & back of that check.  I really need a lawyer that would be willing to handle my case on a contingency basis.  There are plenty of class-action lawsuits against GMAC out there, however, client's usually aren't the ones to benefit from them.  Thanks again.

Carol, GMAC was part of General Motors. General Motors is part of the Federal Reserve.......

You can 'Google' this- WHO OWNS THE FED?, and go to the site with the 5 charts and you'll see that General Motors is listed in 'Chart 3'.

Mail a copy of your Ripoff Report to President Obama immediately, so he knows what's going on. His address is available at this site. Just type in 529757 and go to 'Consumer Comment #29' at Ripoff Report #529757 and the address to the White House appears towards the end of that consumer comment.

Contact all of your Local T.V. stations and get your Ripoff Report to all of their Investigative Reporters. Maybe one of them will help you, like 9NEWS did in Denver for many homeowners. A correction to my statement.  Received the modification agreement on 10/13/10 @ 12:04 P.M. via Fed Ex.  The "cover letter" stated the signed agreement was due back in their office by 10/15/10, but the actual agreement itself required the 1st payment due 11/1/10.  Of note, every cover letter that GMAC sends with the modification application itself states as follows:  "Permanent Modification:  If approved, you will receive the permanent modification document. Sign, notarize (only if required) and return within "seven (7) days" of receipt".  So even forgetting the fact that I requested & was given an extension by phone, they did not comply with their own written protocol on the seven (7) day period for returning the signed documents.  Furthermore, during the period of review for "each" modification application, as I stated, they refused to accept "any" payments from me, stating arrears would be included in the modification.  When I asked why, I was told that any payments would conflict with the information in the hands of the reviewer.  My 1st application took from  6/23/10 to approx. 11/4/10. My 2nd application took from 11/18/10 to approx. 12/29/10.  My 3rd application took from 1/26/11 to approx. 2/18/11.  My 4th application took from 5/11/11 to yesterday, 6/2/11, when I phoned & was advised that a denial was just done yesterday.  In all applications my income & expenses were basically the same...no circumstance change there.  However, you are right that the arrears are now more than they were @ original filing, but would not have been had they allowed me to reinstate my auto-pay when I originally asked to do so in July, 2010 and numerous times to this date.

My mistake for not being more clear

The modification agreement required that the 1st payment be made on 11/1/10, so yes, the grace period did in fact end as I said on 11/15/10.

- If the payment was due on 10/15 the 15-Day grace period for that payment would be 10/30 not 11/15.  So if this is the case when they got it on 11/5 it was too late.  Then when you re-applied either your situation changed or their guidelines changed.
