I have had an automobile loan with First Citizens Bank since July of 2004. My company went out of business in 2006 but I have continued making my car payments although not always on time. After making 57 of the required 60 payments, I fell more than 30 days behind. On November 18, 2009, I spoke with Mr. Kevin Bryant of their Collections Department. I requested additional time to make my payment. He indicated that they could just "charge off" the final $1800 and send me a 1099 for that amount.


I told him that I would rather continue to make payments but finally agreed to the "charge off."


At two a.m. on Friday the 20th, two repo men came to seize my car - a traumatic event for a couple in their 60s.


Mr. Bryant never once mentioned that repossession was even being considered but I agree that they had the legal right to do so.


At 9 a.m., I called Mr. Bryant and told him that a mistake had been made and my car was confiscated. He said that he had it seized because he had the legal right to do so even though it was never even mentioned that it was being considered.


I had to borrow money and pay off the loan ($1809.41) PLUS $535 to the repo company to get my car back. This all could have been avoided if Mr.Bryant had been honest in the first place but he took too much enjoyment in exercising his power to inflict pain on others.


Do not do business with First Citizens Bank until Mr. Bryant is fired.
